Customer returned product from an order that was placed in July of Her complaint is that she believes the item is not authentic and all bottles were returnedSince we are unable to return the funds back to the original payment method( after days we are unable to refund back to credit
cards), customer was issued a FNet gift cert, which she does not wantIn efforts of resolving the claim, can we send customer a refund check

*** *** spoke with two (2) customer service agents and after listening to the recordings of both conversations, I did not hear either agent say anything “hateful” or ”demeaning”. However, the 2nd agent *** *** spoke to was terribly rude to her. Although our policy did change regarding coupons over the phone, neither agent did anything to help *** *** place her order on the web, nor did either agent offer to place the order on our website for her which is TOTALLY UNACCEPTABLE. Our agents were well educated when our policy changed regarding coupons over the phone. I find it deplorable the way *** *** was treated. Both agents have since been “re-educated” and I trust they will not make this type of error in the future. I sincerely apologize for the frustration *** *** received regarding our services and would like to offer her a $gift certificate should she choose to use our service in the future. This gift certificate will be accepted over the phone and if *** *** would like to use a coupon as well, please assure her that the Customer Service Representative will honor her coupon. The response by the business is disingenuous. The document presented as "evidence" that the offer may be refused is nothing more than documentation from their website, which does not reflect the reality of how the ordering process actually operates. If an order is placed on the website, the "free offer" is presented. I definitely "rejected" this offer as I was given a choice of several magazines, none of which interested me. Despite my "rejection" of this offer, I started to receive magazine subscriptions against my wishes, and my personal information was shared with a third party, also against my wishes.This kind of inconsideration by businesses is why I reject this resolution until Fragrancenet.com can provide more positive proof that their website will not forward information to MMedia unless the purchaser provides positive acceptance that they are subscribing to the magazine, meaning that a customer's inaction or requirement of "opt-out" will not automatically cause a subscription to be createdThey should test their website for operation to ensure that it is in fact performing the way that is stated in their documentation, which at the time of my complaint it was not. To accurately check if the site does allow opt-out requires a purchase be made, and without assurances that it is working properly, I will not make a purchase to verify its operation, so I feel it is fair to ask Fragrancenet to do the checking.It seems the businesses involved are often of the position that no harm could
come by receiving a free magazine or two, but they often don't consider
all possibilitiesIn my case, my mailbox is quite small but sufficient
for receiving all my billsWhile traveling, this billing-only mailbox
began receiving magazines, and so my mail was delayed causing a bill to
be delayed, and resulting in late charges.Previously, courts have viewed "inaction as acceptance" to be valid terms, but more recently have been rejecting these defenses in lawsuits where monetary or personal damages have occurred, especially when privacy policies are concernedIt should serve as a reminder that although Fragrancenet is a New York corporation, it is doing business in California and other localities and must make note of the codes in those areas (example: the California Transparency in Supply Chains Act is applicable to many large companies based outside of California that wish to sell to its residents)I hope that Fragrancenet can research this trend for themselves and see they should be distancing themselves from companies such as MMedia that are not in compliance with current case law.

I did not order this "Second Bottle" of Shampoo, they sent it to me in Error. I only ordered One bottle of Shampoo $45.29, Not two bottles. They made the Error in sending me Two bottles & charging my Acct$Twice. I mailed the Second bottle of Shampoo back to them for $since all of their Return Labels did Not work- I could Not print them as I told them. They made the mistake in sending me the Second bottle, therefore, they Owe me the Shipping Cost of $that I had to payIt is Not my fault that they made the mistake of sending me a Second bottle of Shampoo & Charging me an extra $for what I Did Not order I will Not accept the Store Gift cards or anything else but Credit to my Debit Account which I don't see any reason why they cannot do, since I do Not plan on buying anything else ever again from them.
