[redacted] joined the gym on 8/22/16 with a Premium 12 Month membership @$19.99.  This membership includes access to all the gym facilities as well as any and all classed offered at the gym. There is a 12 month commitment which can be broken by early cancellation with a $59 Buy-Out...

fee.At the end of August a decision was made to eliminate 2 of the previously scheduled yoga classes due to low attendance, however there are still yoga and body pump classes on the schedule.  The fact that the class schedule changed does not void the Membership Agreement as specific classes were not purchased, only the availability of classes and use of the gym equipment is paid for.  Since [redacted] states she only wanted the particular classes that are no longer in the same place on the schedule she observed in August she has requested cancellation and her cancellation request has been processed according to the terms of the Agreement she signed when she joined. RespectfullySheila K[redacted]Billing Manager, Fitness Evolution Home Office

Hello,The collections agency has already been contacted to remove the balance by Fitness Evolution as of 2weeks ago.Since this was a paid in full membership, and cancellation was not requested within 5 days, the member will not receive a refund. The collection issue, however, has been taken care of.

Our notes show the member was attempting to do trade in promotion. The attached notes indicate the member spoke to our corporate office and the member was advised to send in proof of membership cancellation from the other club, so we honor the promotion.   [redacted],  I also have reported this to the police department due to the theft of my wallet. Your contact logs should date back when the first charge was made for 179.96.  Please return the funds back to my account dated: 08/02/2016 179.96 & 09/02/2016 for 78.99. I reported this account fraudulent the day of these charges to your clubs (called multiple locations to make them aware to flag). In addition, I've wrote in- I've also went to your website as well and got no response until I reported this to Revdex.com. Please let me know the next steps & assure me this account has no access to my account information as well.

I am rejecting this response because:While they have done some to rectify the situation, I still cannot get a hold of [redacted] and was owed additional visits from past months when my previous trainer, **, cancelled meetings.  Which he told me that those missed meetings would be added to the END of my contract.  I have text messages, etc showing his cancellation. What should I do? Thank you for your help.

The member was notified by the club and warned verbally, more than once, that the motion cage is for personal training use only. There are plaques by the motion cage and it is roped off with a sign that says "for PT use only". The staff felt that the member was discourteous regarding the matter. The membership contract states that the Club may cancel Members membership at any time for breach of the club's rules.

I am rejecting this response because: I have nothing more to add to my initial email.  When we came in to the gym to cancel we were told that the manager was out and that their system was down and we would have to come back.  We called at that point.  This was prior to July 1.  We were then contacted via email after the 1st and told we would be charged.  I have copies of the emails in which I stated that we came in for the no contract deal and were up-sold to the more expensive plan that included classes, but were not told about the contract.  We'll have to agree to disagree on this point.

Fitness Evolution took over [redacted]s in April along with all of their members.  Your account was transferred over as an active account.  The notice you received did not state your membership was terminated, it stated that the payments had been stopped.  In order to terminate the...

memberships a written request was to be provided 10 days prior to the bill date per the [redacted]s agreemente.  The balance is valid as you did not properly terminate the membership and would not be able to issue any refunds.

Can you please provide additional information so we may look into this membership. The details do not state the member's (daughter's) name, which we need to look up the account.  Do you have a membership number?

I am rejecting this response because:I refuse to pay anything to this company, I tried to cancel my contract on the 6th day from signing up. The attached is what they mailed to my home and the notes I've kept from each time I called to try and resolve the charges! That's not even counting how many times I went in person to their gym and speak to their general manager [redacted]. We signed up on 3/21/16, their contract says that we have a 5 day cancellation right, so I called them on 3/25/16 to ask if the $108.99 balance was waived off the account. That's when I spoke with [redacted] who confirmed with me that the balance would not go through due to their promotion. Then the April came around and the charges were applied!! So we went in person to talk to [redacted] who gave me their corporate phone number (that they never answer or return calls) and their "reps" e-mail (who also Never replies) and nothing was corrected. We tried to clear it numerous times in person, on the phone, and by e-mail. So no, we Do Not Owe them Anything because we tried to cancel within the allowed time and we were lied to!?!? This place is false advertising!! I didn't seek their business, they looked for mine! It is so frustrating that this place is in business of lying to consumers and no one is doing anything for the protection of the consumer!! I cancelled my five year membership with fitness 19 for this BS!! Where are the rights to the consumer? I trusted these people, I gave them my account information for god's sake, and this is what they do?!?! Lie, string customers along so that the time to cancel expires and Oh now you owe me this?!?!?

Hello   Thanks for your reply, I dont recall the exact day as its been an year almost. please check your video recordings or they even scanned my membership card while they are freezing my account.
