Hi [redacted]. Thank you for the information. We did not have a cancellation form on file,...

I am rejecting this response because: Hello,Thanks for your prompt reply, please check your Camera...

Recordings at the GYM I stop by every 2 months and asked for freezing my account. I even talked to the representative at the Front Desk about the charge she said that they had a glitch on their system as some other people also complained the same. Please check your Video recording for Proof.

The member was emailed a refund form from our office for his PIF amount. We are still awaiting receipt of the form from the member so we can  issue the refund.

Hi [redacted]. Your refund form was sent on 1/6. Please sign and return to us and we'll get your check expedited.

This complaint has been thoroughly researched and we stand by our initial response.  We understand that our response has been rejected.  No further action will be taken.

Hello, At your request, on April 8th our corporate office did reach out and call you at the number provided. We have yet to have a  return call back. Please let us know how you would like us to proceed.

Positive: when you first start up with this gym everyone is nice friendly smiling and very warm and very helpful but it's only to get you to sign up.
NEGATIVE : after I signed up with Fitness Evolution I was completely ignored. The staff was not as friendly. I've had issues with billing on more than one occasion. I was told when I signed up there will be no contract and I'm still getting billed even after I cancelled my membership. I spoke to a manager and he was extremely rude he talked to me in a manner that a manager should never talk to a customer. When I ask for it his boss's number he gave me the run around and I have still yet to been in contact with anyone other then the rude manager to talk about the issues that I've had with this gym.

Hello. I recently filed a report a few months back about a business that would not close an account and continued to charge me. I was given a case number and once the matter was claimed as addressed, I thought my troubles were over. I was told all I owed was $13.99 even though I canceled prior to the charge date. I went to the gym to make the payment 2 days ago and was told I owed $76 dollars and some change. Just today I received a letter from Collections stating that I owe $234.00. I am beyond frustrated and at my breaking point of frustrated and stressed. I have worked very hard to keep my name and reputation clean and now have wrongfully received a debt collection letter having been officially my first one. I am hoping to have my case re-opened and this matter addressed and hopefully clean up my name from this wrongful doing. I don't know what they are doing and I need to know what is going on. The collector that I have apparently been sent to is from [redacted]. I really need someone to get back to me as soon as possible. This situation is pushing my anxiety over and stressing me out in more ways than one. Thank you for your time.I hope for an adjustment and for this issue to be permanently resolved as soon as possible

There will not be a refund issued as we do not give refunds on paid in full personal training.

Hi [redacted], we apologize for any inconvenience and will address this with our team.

Hi [redacted]. I'd be happy to help you with this issue, but I'm not seeing the charges you described. In addition, being charged monthly would indicate we did have correct billing on file. Perhaps we just had the incorrect phone number? But I'm not understanding the $115 charge. Please provide more...

information so I can help you in resolving this issue. Thanks so much!

Revdex.com:
I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

My bank records show no distribution of funds to Fitness Evolution. The manager of the Brook road location, [redacted], also confirmed that on my initial conversation with him in November. The amount that Fitness Evolution said that I owe is also the total of 6 months of dues plus a $10 fee that they agree to suspend for a late payment. If my account had paid them for one of the months the bill would have been $19.95 lower than what they say I owe. Even still, why did no one communicate with me that my account was delinquent? They have my address, my phone number and my email address. It seems to me that a simple communication when the autodraft account became 30-60 days overdue would have been a good business idea, rather than just waiting 6 months and sending me to collection.

To me this is an open and shut case. I made a solid effort to fulfill my agreement, but was told that agreement did not exist in August. Once a problem was made known to me I attempted a compromise to resolve the matter, even though I felt I was completely in the right. I feel that the manager of the location was understanding and in agreement with me. [redacted] even communicated verbally that he could see were they had made a number of mistakes handling my account. I have never seen or heard of a company who's customer service policy includes representatives not answering the phone or email with questions. I also don't understand a corporate customer service department that has no phone number for communication and also does not respond to emails sent to them through their own web site about the business practices of one of their locations.

I will be out of the country for 2 weeks and have no access to email or phone. I will be happy to meet with the representatives of the company anytime after March 28, 2014.

If Fitness evolution has evidence that my account was debited, I would like for them to send me a copy of the details so that I can review them with my bank.

Regards,
[redacted]

As the attached documents show, the complainant signed the membership registration agreement and paid a signup fee of $3.43 for the month of January.  On Feb. 1 the dues of $9.99 were collected. On Feb the complainant requested cancellation according to the terms of the membership agreement....

Cancellation requires 30 days notice and an additional full month of billing, therefor the March 1st billing for dues and Annual Rate Guarantee Fee on March 9th .Both the membership agreement and the cancellation request have the same email address as the complainant has used here. These forms are automatically sent at the time of processing.  The balance remains and the member is responsible for all fees incurred. We have upheld our end of the agreement and cancelled future billing. The membership agreement and cancellation request have been resent to the email on file.  During the sign up process the prospective member is required to acknowledge that they have read and agree to the terms of the agreement before any money changes hands.

At this time the members is only paying for a basic membership. The club does have group ex classes, tanning and hydro massage available. The member can cancel her membership, if she would like. We do not show that she has ever made an attempt to do so.
