I am rejecting this response because: I have nothing more to add to my initial email.  When we came in to the gym to cancel we were told that the manager was out and that their system was down and we would have to come back.  We called at that point.  This was prior to July 1.  We were then contacted via email after the 1st and told we would be charged.  I have copies of the emails in which I stated that we came in for the no contract deal and were up-sold to the more expensive plan that included classes, but were not told about the contract.  We'll have to agree to disagree on this point.

I am rejecting this response because:I refuse to pay anything to this company, I tried to cancel my contract on the 6th day from signing up. The attached is what they mailed to my home and the notes I've kept from each time I called to try and resolve the charges! That's not even counting how many times I went in person to their gym and speak to their general manager [redacted]. We signed up on 3/21/16, their contract says that we have a 5 day cancellation right, so I called them on 3/25/16 to ask if the $108.99 balance was waived off the account. That's when I spoke with [redacted] who confirmed with me that the balance would not go through due to their promotion. Then the April came around and the charges were applied!! So we went in person to talk to [redacted] who gave me their corporate phone number (that they never answer or return calls) and their "reps" e-mail (who also Never replies) and nothing was corrected. We tried to clear it numerous times in person, on the phone, and by e-mail. So no, we Do Not Owe them Anything because we tried to cancel within the allowed time and we were lied to!?!? This place is false advertising!! I didn't seek their business, they looked for mine! It is so frustrating that this place is in business of lying to consumers and no one is doing anything for the protection of the consumer!! I cancelled my five year membership with fitness 19 for this BS!! Where are the rights to the consumer? I trusted these people, I gave them my account information for god's sake, and this is what they do?!?! Lie, string customers along so that the time to cancel expires and Oh now you owe me this?!?!?

Per charges on account, only one payment was made from the member from the time of sign up to termination of $14.99. All other charges returned. See attached transaction history. Note history reflects more than once member was not cooperative with different staff members. At the time of termination, there was a balance on the account that was removed, per transaction history.

The member was notified by the club and warned verbally, more than once, that the motion cage is for personal training use only. There are plaques by the motion cage and it is roped off with a sign that says "for PT use only". The staff felt that the member was discourteous regarding the matter. The membership contract states that the Club may cancel Members membership at any time for breach of the club's rules.

To terminate all membership there is a 30 day written request that needs to be provided to terminate the membership any and all fees during that time need to be paid in order to complete the request.  We have waived the 30 day notice and not additional fees will be charged to the account.

I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me as long as they honor their statement to provide me with a refund. We do have some advertising for our Basic membership plan at $9.99 but also offer other plans. Your agreement was for a Premium membership, discounted to $17.99. Please see attached agreement.

We do not have any record of an inquiry to cancel the account. The member was notified of the balance due on the account in May and June of 2014. We do show this as a valid balance, however we are taking the $300 already paid as a settlement payment and we have notified the collections agency to...

Hi,All of our month to month membership accounts have a $39 rate guarantee fee, which is in the agreement.  A copy of the agreement was resent to the member to review after she spoke to our staff. The rate guarantee is a valid charge.

Our PT agreement does require that cancellation be done within 5 days in order to receive a refund. We are unable to issue a refund. We show that there are 6 sessions left on the account and the member is still able to use these sessions. We can work with the member to set up convenient training...

11/14/2014Fitness Evolution issued a return in the amount of 158.99 to [redacted]. The billing was found to be an error that has been corrected
