I am rejecting...

this response because:Every month the dues are automatically withdrawn from my [redacted] account- two payments per month of $20 each for our memberships under the names of [redacted] and [redacted]. Their argument makes no sense.This is absolutely ridiculous. It seems that now they are coming up with this bizarre story of "past due" or "outstanding balance"... If this is the case, why hasn't a word of this been spoken to me when I've been calling multiple times per day for the past week??Thank goodness for electronic banking- I have every posted payment since last year that I can easily supply, if needed. This is so absolutely insane- as a matter of fact I will be contacting the several other people who have been overcharged (I know of 4 people, so far) and see what we can do legally as a class action lawsuit.

I am rejecting this response because:  I understand where the funds went, however I was not informed this would be happening....

 If I had at least received an email, voicemail, anything, I would have been prepared.  I called the gym to find out why I hadn't received a reimbursement.  I was then told it was applied to my gym membership.There was never any response to my repeated calling.  No one ever picked up the phone for a "corporate" office.  I continued to contact the gym to at least speak to someone.Very unprofessional.As for the cancellation, I was not told it would be 30 days before the cancellation went through.This could have been already resolved, but because there was never any communication on your part.  From my understanding, this company strives to make their members satisfied.  Clearly that is not true.

He stated that the 6 month free member is really a credit for 6 months and the $39.99 is a fee charged to price lock since they have no contracts. This was not listed on the coupon but he explained that to the customer after the coupon...

I do not show we have received any request to cancel the membership and it has remained active.  What I'm able to is cancel the membership effective immediately, however there will not be a refund issued.

I am rejecting this response because: it was over 5 months ago since I hurt my back so ofcourse I dont have a drs note. But thats irrelevant because it should show in your records that I personally went in to cancel the personal trainer contract,  and because it was within the window of cancelation, you just had to honor my decision. I dont need to show you anything/proof, I could have just changed my mind if I wanted

The member must provide proof of new residence that is 25 miles away to receive a refund. Must be a  current bill or lease with the member's name and new current address.

Hi [redacted]. We received your 30-day notice to cancel in March, charged as scheduled in April and have now cancelled your account.

We requested a copy or the tracking number of the certified letter that was mailed to see when it was mailed.  The letter provided does not confirm it was actually received or processed.  Please provide the information of the certified letter for review.  If you are unable to provide proof of the certified letter the account will remain in the current status.

I am rejecting this response because:Again whom ever is responding with this information need to come with the facts  not excepting anything that they are stating its all lies they're just trying to save there name from being drug in the mud by making up things about me that are untruthful. I was promised 2 free months of gym service when I signed up at fiesta days in Vacaville its a fair they run every year they had a booth there and the young lady by the name of [redacted] was the one who signed me up. When they attempted to debit money from my account it supposedly returned but when I contacted my bank they told me that nothing was ever received or returned by that merchant. I then came in prior to the day that this entire altercation took place and the gentleman advised me that payment was returned but it was not due to insufficient funds which I already knew that it couldn't have been being that its the only account I use to pay all of my bills and I always have money in this particular account. The gym manager at the time said she would get back to me after she got back from vacation but that never happened because she never came back. I still haven't heard anything about my headset being stolen no one has even addressed that matter yet. I don't appreciate anyone lying on me trying to make me out to be some trouble maker we can get statements about y character if that's nesssesary. I again not once EVER BROKE ANY GYM RULES OR DISRUPTED THE GYM AT ABY TIME SO PLEASE STOP WITH THE LIES ALREADYALREADY!! My account should have never shown any amount due it was suppose to be corrected by the gym manager her in talked about this prourprour she just never kept her end of the bargain. Secondly the district manager [redacted] is a disgrace to the company its funny because I just recently visited another fitness evolution gym with a friend of mine because she just moved and it was close to her house as I did warn her about what happen to me as well as tons of other people she wanted to go in their  and take a look at it for herself well as I was talking to one of the managers that was trying to get me to sign up I had to explain to him why I would never ever give my money to this corporation I was about to tell him about my experience with [redacted] and before I could say her name he mentioned it before me because he stated he already new how she talks to people and that a lot of people have a had issues with her. If the company is so confident about Ms. [redacted] working for there company I challenge them to do a random survey with all of the evolution gym that are within her district and ask the employees how they feel about her and see what they say. I don't see this place lasting for the next 5 years between the customer service, unprofessionalism, dishonesty, and billing issues there's no way any business could survive that long running it the way they are!Above I attached only some of the reviews on [redacted] that you can find about them from a mixture of different locations explaining some of the same issues AMD complaints that people have experienced with this company so you can be the judge of it.

I am rejecting this response because:My credit has been affected and the FE has not taken actions to repair it.Fitness Evolution claims that I was enrolled under auto-renewal. I have requested Fitness Evolution to demonstrate that I gave permission and approval to be enrolled under auto-renewal. Fitness Evolution has not yet provided any proof.

Hello, The initial $1 payment was cash, I have attached the receipt. I also included a copy of the correspondence from thecompany to the member regarding account status. Calls were placed to the phone number on file.

Hi, I apologize for the delay in getting your refund check. I sent your signed refund form to our accounting department for expedited processing.

The only cancellation notice on file is from February 2016. Per MCR agreement, the member must give 30 day notice in writing. If member can submit proof of cancellation prior to February 2016, Fitness Evolution will gladly issue a  refund.
