I need your help in discontinue poor service and fraudulent behavior.Desired Settlement: I would like for the stop using my bank information and billing for a membership I no longer have and would like a refund for the cancellation fee and the membership fee recently credited from my account.

Review: I have been trying to cancel my Membership Since the end of January 2015. At first they tell me I have to make a appointment with the manager and she is not here at the moment and they cant tell me when they will be here, so to leave my name and number so the manager and call me to make an appointment. So two weeks go by no phone call, I then go back to the gym and then they tell me she will be back tomorrow morning. So I go back the next morning and she tells me that's not the way you cancel a membership, you have to send a letter by certified mail. but it takes 30 days to process so I will be charged for one month. so two months go by now the tell me I need my receipt to prove that I canceled the membership and now my yearly membership fee is due. So I then ask if I can have the number to their corporate office, and they tell me they don't have the number so I would have to go online to their website.Desired Settlement: Just cancel my membership and if this does not get resolved in time, also refund the membership fee that will be coming out of my account at the end of this week.

Business

Response:

I'm showing there is a signed termination request form filled out on 5/14, there will not be any further charges on the account and the membership has been terminated.

Review: I tried cancelling my personal training session because I got another job and the job will be too far from the gym.I was told to send a certified letter to the gym. I did, spent 5 dollars. I got a call that they received that letter, and they would give it to [redacted] so he can help me with it. The personal trainer texted me and told me that my 140 dollar cannot be refunded. It can be refunded after 4-5 days of purchase but when I tried to cancel the next day, the manager told me that I cannot cancel it. I was not told about the contract, the cancellation policy..no word about it at all!!!

Review: On October 2, 2014 I joined this gym. Due to the filthy pool conditions I cancelled the very next day, October 3, 2014.I have spoken to [redacted] many times over the past several months to get my refund of $49.32 sent to me. [redacted] has stated that the refund takes up to three months. We are well past the three months and [redacted] supplied me with and phone number which no one answers.I still cannot get anyone to send me my refund or return my phone calls.I am 80 years old and on a fixed income and this money means a great deal to me.Desired Settlement: I request a refund and any other monies due to me. I also want the public to know of there negligence.

Response:

I do apologize for the delayed response from our staff. I will be issuing a credit on the account that was provided at signing. This should take a few days to reflect on your account.

Review: I normally don't even take the time to write out that many reviews but sometimes it's necessary and if I could give a zero review for this business I would they don't even deserve one star. I joined back in May of this year and was offered a special deal at fiesta days and signed up on the spot. The Gym didn't actually open until mid June in the beginning it seemed to be cool with a very nice atmosphere even the staff seem to be pretty nice. Then about a month in to my membership I start experiencing problems with there billing. For some reason they kept stating that my membership fee kept kicking back and wouldn't go through I know that there was plenty of funds on the card and I never received anything stating that my payment was returned. Mind you my membership fee was only $14.99 per month and then drop down to $13.99 per month because I got someone to sign up. Up to this point I've said nothing but great things about this Gym to people that I know trying to get them to join but now I see that I definitely spoke way too soon without having more facts and information about this corporation. My view has now took a complete 360 due to the horrific experience that I had with one of there Regional Managers. She was so disrespectful and so unprofessional I was completely shocked that they would even allow someone with her personality and attitude to represent there company. I came in with a friend of mine to workout as usual and happen to ask one of there associates that I know if the club manager was ever able to clear up the discrepancy that was on my account that they had just brought to my attention days prior he advised me that she hadn't been in the club as of yet but that he would see what he could do for me to clear it up once he was finished helping his current guest. another lady that I had never seen before offered to help me since he was occupied with another person so I was OK with that. She went about trying to explain to me why my account was showing fees owed when really it should have been at zero due to the fact that I was promised 2 months free if I brought in a cancellation form from my previous gym (which I did do) but she insisted to keep talking over me and attempted to further explain why the fees were on my account. Mind you this woman had no prior history about my account she had never talked to me before I tried to explain to her that the club manager knows and understands what's going on with my account and that I would prefer to deal with the matter when she gets in. This woman felt that it was necessary to belittle me and talk down to me as if I was uneducated or incompetent she was speaking to me in a very disrespectful and degrading manner and kept saying "its very easy to understand this if you just follow me and listen to what I'm saying" she was basically insinuating that I wasn't understanding what she was saying to me when really what it was is I was not AGREEING with her explanation of my account and kept telling her that she's incorrect that's why I wanted to handle it with the club manager at a later time because she wouldn't fully allow me to explain what's been going on. She proceeded with trying to explain my account to me about 5 times meanwhile my friend had been waiting for me for about 30 minutes so we could workout and we were on time constraint. So now at this point I'm getting frustrated that she's cutting in to my workout time and is somewhat forcing me to deal with the issue right then and there. I finally Just said to her "look I will deal with this at another time I didn't come in for this anyways I just asked a simple question" it wasn't that serious to be debating fees that weren't suppose to be on there in the first place. I told her "at this time we will Just have to agree to disagree because I'm starting to get annoyed at the fact that you're being disrespectful to me not only because of the way you are speaking to me but also because you're interrupting my time when I could be working out". She then stated that since I am so unhappy with what's going on why don't she just cancel my account and I'm looking at this lady like did she really just say that. At this point I see that she didn't like the fact that I was trying to cut the conversation off with her so I could continue to go work out with my friend so she felt it was necessary to try and escalate the situation by threatening to cancel my account for absolutely no valid reason at all other then to get under my skin because she could. A real professional person wouldn't conduct themselves that way they would listen to the customer and avoid any conflict at all cost then she could have verified everything that I was trying to explain to her about my account with the club manager at a different time. But instead she rather argue with me just to be "right" and to prove a point when she didn't have one to begin with. You could tell that the only thing she cared about was moneyDesired Settlement: I think I'm owed an apology as well as an explanation from the vice President that I spoke to directly about the situation promised a call back and never called me back which is very disappointing and extremely unprofessional in my opinion and pretty much I feel that they're the ones that should come up with a resolution not me I'm the one that was disrespected and discriminated against I really felt the vice president took sides with the district manager because they are friends and all they seem to care about is taking people's money

Member was terminated for violation of club conduct policies. There was a disagreement over charges on the account. Member began to yell and curse at the staff. After some time, she was asked to leave and police were called to have her removed from the club due to the escalation of the disagreement. Letter was sent to the address on file regarding the situation and the termination of her account.

Response:

I am rejecting this response because: whomever came up with these accusations is a complete liar I never once violated any of the gym policies this is all here say from the very person that I had a problem with this company would rather take sides with someone within the company instead of listening to there customers I have been too many gyms all around the north bay and never have I ever in my life been accused of violating gym rules or policies. Nor have I cursed anyone out inside or outside the gym I'm appealed that someone would go to such great lengths to try and fabricate a story to try and save themselves or position with the company . I am beyond offended to hear all of this and then to top the lie off they claimed to have sent me a letter which never came to me I spoke to the vice president myself and in his own words he said that he would be Calling me back. Its funny that a corporation would even try to ruin someone's reputation with lies when they are not doing so great with there business as it is I personally know to prior employees that quit because of the horrible management within the company. Like I mentioned in my previous message one of the employees quit right on the spot because of the way the district manger was be Kittling him in front of the police and let's not get it twisted there was absolutely no reason for the authorities to be called in the first place when I decided to walk away from Ms [redacted] because I wasn't comfortable with the way she was speaking to me in front of the staff members as well as the customers but NOT ONCE DID I EVER USE PROFANITY so if somone is going to make statements about me they better make sure they have all of the facts first because again that is extremely insulting and you know what the truth will always reveal its self people and businesses cannot keep going around telling lies about others and treating people in a nasty way I brought business to there facility and everyone that knows me knows my personality and the type of individual I am and would shake there head in disbelief if they heard this crazy farfetched story and to top it all off I told not only the manager of the facility as well as the president that my Bluetooth headset was stolen or taken and that the manager said that she was going to get back to me after she contacted the dep who handles the cameras and when I told the president this he just brushed it off like it was nothing and never addressed it I'm going to persue this matter and make sure that I contact everyone that I know to expose this shady company and everything they're about taking people money even after they cancel they're membership so disgusting!!!i have witnesses if messes art to prove that I'm telling the truth and that they are lying I know [redacted] was the one who said all of this and they just automatically took her side over mine because she works for them they messed with the ring person I will be contacting y attorney ASAP if I don't get a formal apology from this its the principal and I will call the police as well because even they can tell they're version of the story she threatened to cancel my account because I didn't want to speak with her any further since she was being disrespectful and cutting me off anytime I tried to explain what was happening with my account ask the employees how they feel about [redacted] I challenge the corporate to do a survey wit all of the gyms that [redacted] handles and see how the employees feel since I'm the so called liar and trouble maker I wouldn't have even waisted my time to write this if it wasn't the truth!

Per charges on account, only one payment was made from the member from the time of sign up to termination of $14.99. All other charges returned. See attached transaction history. Note history reflects more than once member was not cooperative with different staff members. At the time of termination, there was a balance on the account that was removed, per transaction history.

Review: In the month of 08/13I visited Fitness Evolution and decided to join their club. A staff member told me I need a bank account to apply. I then said I did not have a bank account but a prepaid card. She said that was fine. She then charged my card for $9.66 cnets and opened my account. The next day the manager denied me access to the gym because I did not have a bank account. I then explained to her how her employer took my money and opened an account. She then told me to come back in a week to she can see if she can give me a refund, but I would not have access to work out in the gym. She said to contact the email address about closing my account, so I did. When I went back she said she will not give me a refund since I had access to the gym.I told her that was a lie because she personally denied me. She closed my account until the email address responds back. They never did.Desired Settlement: I feel that I should recieve a refund since the mistake was made by an employee of fitness evolution, and I should stop being billed since I am not allowed to be a member because I only have a prepaid and not a bank account.

Per your signed membership agreement the sign up fee will not be refunded as we do have record of you utilizing the facility within the 7 days.

Review: Cancelation of gym membership last year and then come to find out I've been charged the last 2 months without knowing

I had told the gym to cancel my membership in October 2012. They ended up only freezing my account after getting my signature. I thought I was signing to have my account frozen like I had told them I wanted to do. I then left the gym after canceling my account. I go to look at my bank statements this week (June 6,2013) and realize that for the last two months they had charged me $25.00 for a membership I thought I had canceled. I called the gym complaining of course because I had no authorized them to take out any money of my account. After canceling it they should have NONE of my bank information anyway. The guy said that they had only frozen my account and that after the end of May they charged my account again. I went in and canceled my membership again and said that it shouldve been canceled last year and that I was upset that they kept charging me without my knowledge. I asked for a refund and said that they could not legally do that and just take money out of my account without my knowledge. He said that he would not give me a refund and after I asked for corporates number to file a complaint and try to get my refund he stated "we don't have a corporate number and if we did we wouldn't give it to you." I was enraged at this and after he told me I had to "file a complaint online." When I got home I did just that, I emailed corporate and explained to them my problem and said that I wanted a refund due to their staffs incompetence. They did not even have the decency to call me back but only emailed me brushing off the issue saying they wouldn't give me a refund and that they would waive the cancelation fee. (I would hope so since I did this in October of last year). I was looking up reviews about this company and I have read horror stories about this gym (Fitness Evolution) charging people $1400 dollars and not issuing refunds. This gym is completely incompetent and I should be issued a refund for all this trouble I've gone through. Especially when I had told them to cancel it in October in the first place! They do not answer any questions and act like they are not at fault for the situation. They should not have charged my account twice, it is ridiculous and uncalled for. Desired Settlement: I have told the company I wanted a refund and they have said no. I find it hard to believe that they can just charge someones account without their knowledge. And it is ridiculous that they only froze my account after I told them to cancel it. I feel manipulated that they just made me sign something after telling me something different. Money should have never been taken out of my account without knowledge and they shouldn't have my bank information anymore after a cancelation anyway. I am seeking a refund of the charges they put on my card in May 2013 and June 2013 which would total $50.00. It is absurd that I have to go through all this trouble for $50.00. I am so upset with the lack of professionalism of this company all together as well as their corporate office. If I do not receive a refund I want to take them to small claims court. I am sure I am not the only one this has happened to with this gym.

Business' Initial Response

We apologize for any inconvenience to Ms. [redacted]. Unfortunately, our records show that Ms. [redacted] requested to freeze her membership. We provided Ms. [redacted] with proper documentation showing that the signed request was to freeze the membership and to begin billing at the end of the freeze, deeming all charges valid. Also, Ms. [redacted] was provided a copy of her membership agreement that states the proper process to terminate her membership.

Review: This company is trying to collect on "past due membership" fees that I did not sign up for. I was on a prepaid non-contract 1 year plan with [redacted]'s.

In 2013 I signed up for a 1 year prepaid non contractual plan for [redacted]'s Fitness. [redacted]'s was bought out by Fitness Evolution sometime ago and as far as I was concerned, my membership expired around March or May of 2014. I did NOT renew or ask to be renewed with either [redacted]s or Fitness Evolution.

I received multiple calls from their debt collectors agency BEFORE I was notified in writing. This is against the law because I was not given any information beforehand either in writing or by phone by the actual company stating I owed them membership fee. This has caused emotional disturbance and I hate the feeling of being harassed.

I called yesterday and spoke with [redacted] around 640PM PST and he stated to me that he understood and admitted that FITNESS EVOLUTION's computer program did not exactly line up with [redacted]'s so I am experiencing what I am experiencing today. I tried to call again this morning around 9:15AM and spoke with a supervisor named ** who stated that my plan was set on auto renew. I emphasized that I did not sign up for any renewal plan because I did a PREPAY membership which means I can choose to renew in the event my one year plan ends. I did NOT renew. So AJ states that I have to settle by paying. REALLY? It was PREPAID... HOW THE FK DOES IT BECOME AN AUTO RENEWAL PLAN?

I keep asking to speak with the manager but no luck. NO FKING CUSTOMER SERVICE. This is a matter of falsification of documentation and harassment. PREPAID is PREPAID. There is no such thing as auto renew on PREPAID PLANS!!Desired Settlement: 1) I want their stupid debt collectors to stop harassing me.

2) I want their manager to call me to resolve this issue immediately by removing me from their stupid auto renew system that I NEVER SIGNED UP FOR.

3) I want it in writing that they will not be harassing me again by telecommunication, by mail or any other way.

Business

Response:

This is the information that was provided to us by [redacted]s, stating you are on an auto renewal membership. If you have any questions in regards to the agreement you can reach the [redacted]s corporate office at [redacted].

Consumer

Response:

I am rejecting this response because: they are passing the buck. if they had proof of a contract, they would be able to provide it. I am NOT going to run around for your company to provide proof for something that does not exist. you bought out the members from [redacted]s. you should have proof of anything and everything from [redacted]s or be able to get it from them. BUT clearly, fitness evolution does not have proof. DO NOT pass me the buck. I was never billed for any type of service from [redacted]s or fitness evolution before fitness evolution decided to go straight to a debt collector. I have submitted a letter to their debt collector already to refute their claim. provide me with substantial proof. then we can talk about your claim.

Review: My name is [redacted] I'm just letting you guys know I got a membership in fitness evolution February 2nd and they have been charging me two months before the gym was fully open and when I tried to cancel my membership in March 5th they told me I had to write a letter so I can have a statement why I am canceling there membership so when I did that and sent the letter they told me I had that my membership was going to be canceled but they just kept charging my checking account and when I found that they were I told them to stop but they wouldn't I even told them since the beginning.Desired Settlement: DesiredSettlementID: Refund

Review: Hi, my name is [redacted] I went to visit your Gym quite sometime ago I only went one (1) time early in the morning to see how it looks because a friend of mine asked me to start going with her. Well that morning I did sign something but I told the lady nothing will be taken out of my card or I won't be charged for anything at all she totally reassured me no I told her I did not have the money but I will be back when I do get money also they could not find my friend in the system because she was going by her maiden name instead of married name. I have gone over & over with the Manager and she keeps saying I owe every single month since I signed my name it is over $100.00 now ....which I have never walked back into the Gym to use it since the day I just visit to see if I liked it..his has been such a total NIGHTMARE that is why I do not even want to visit places and give information or sign things because then you are trapped into something you were undecided about. I never got a Membership Card or did I even ever go back to use the facilities. something is definitely wrong in this picture. I was told that my signature will not be used for anything else but that I visited the facilities this has been an injustice & misleading I need help to fix this problem since no one is responding to me from upper management.

Review: billed me after receiving certified letter from me terminating my membership. did not respond to my e-mail to them about this problemDesired Settlement: since deleting my membership after receiving a certified letter from me requires a trivial amount of work on their part, they have no right to charge me for this process. It is also puzzling to me how they can extract money from me after our business arrangement has been terminated.

Business

Response:

We received the certified letter dated 1/14/2014, there is a 10 day notice and any fees accrued to the account will be do in order to complete the request to terminate the membership. The last charge that will be billed was for the month of January on 1/20/2014.

Review: In May of 2013 I cancelled my fitness evolution club membership because I moved out of the area. I had to pay $100 cancellation fee. In November of 2013 I start getting bills again from fitness evolution. I have called numerous times to get this resolved but [redacted] at the Stockton location keeps giving me the run around a saying that she has emailed the corporate office to see if she can get my situation fixed. She claims that my membership cancellation was denied because I did not provide proof of moving but I did. She never gave me a receipt or an email of the $100 that I paid for the cancellation. Now when I call she has the front desk lie and say she is busy or not even there. The amount owed on the account keeps growing and I just want to cancel my membership. Please helpDesired Settlement: I just want a receipt of my cancellation papers and for them to close the account with everything paid in full as it should be

I show we received your certified letter dated 11/4/14. There is a 30 day term notice any and all fees due within that period of time need to be paid. In order to complete the request the balance of $14.99 and the last month of December $9.99 needs to be paid. The total balance due is 24.98. To make a payment you may contact your local facility or give me a call at 844-434-8386.

Review: Have been trying to cancel my daughters contract with them for 4 months. They keep charging credit card for services not being used. Now they want another $10 to cancel. This company has very unfriendly business practices and you can not reason with them. I will not pay another dime to this company. I have called 4 or 5 times, sent emails which were not answered: they never told me they needed something in writing for 3 months then I sent a letter certified. Now after another month of charges they say they needed 30 day notice so they charged another month and want another $10 to cancel. The manager told me her contract will not be cancelled until the $10 is paid. Why do you have to pay to cancel???????? Just want the contract cancelled and no more charges to my credit card.Desired Settlement: Just want the contract cancelled and no more charges to credit card.

Business

Response:

Our records indicate that Emilys account has been terminated as of 2/28/14 per the January certified letter request.

Consumer

Response:

I am rejecting this response because: The account was finally cancelled in Feb. I started emailing and calling the location in Sept 2013 to cancel after a phone call to cancel and credit card still charged the next month. The person at the location didn't tell me they needed a certified letter until late January and then after mailing it at my expense they still charged Feb because they said they needed 30 days. I gave notice in email and phone in Sept and Oct. I was treated really rudely and I feel was charged monthly fees from Oct to Feb.

I will not answer any more responses from this business and would advise anyone that wants to join this gym to think twice.

Review: I have tried to cancel my membership with Fitness Evolution as of July 2015. Everytime I went to cancel I was informed that I had to pay the last month upon my cancellation which I did. Unfortunate my cancellation was never documented by the employees who handled it so Fitness Evolution was still taking money directly out of my account, we also informed them that they no longer had permission to take money out of our account anymore due to us cancelling on more than one occasion. After 3 different attempts to cancel with them and being told they couldn't offer us anything in writing, I decided to block their company from taking money out of my account. So the payment for Novemeber and December ended up being blocked. In December we cancelled AGAIN and finally got an email from the corporate office from their representative [redacted]. She spoke with me and had me pay our last bill(AGAIN) to cancel and then sent me an email on December 16,2015 saying that we would not be billed any longer and would see no more charges. Then my fiancé receives a notification to her phone from FItness Evolution saying that They could not process our payment and it was now past due. At this point we contacted their corporate office on six different occasions, leaving 4 voicemails, and 1 very Urgent email. This was all done between February 5, 2016 and February 16, 2016. We did not receive a call back or an email until March 21, 2016. After going back and forth with the representative [redacted], she is now saying that even with the proof in writing that we would not be charged again from [redacted] on December 16, 2015, the charges that they are now threatening to take us to collections over will not be taken off because they claim the charges occurred after we received that email. My issue is we received the email on December 16, 2016 saying there would be no further charges and we no longer owe anything yet the charges showed up on our account as of Dec 18 and 21st 2016 and they will not take them off.Desired Settlement: Take the charges off our account and stop trying to take money directly out my account without permission

Hi,The company does not show any attempt to cancel membership until 12/11/15. At that time, the member paid a balance that was due on the account, but not last month dues. The member had Stopped Payment on 12/15 dues, which would have been last month. That was last payment charged on the account. The company has terminated the membership, with all balances on account cleared.

Regarding accounts:

[redacted] Collection $198.95

[redacted] Collection $148.95

We opened these accounts on 2-26-13. Around the end of April, I went in to the Fit-U and informed them that I would be having Surgery on my knee and that [redacted] would be re-locating for the summer out of state because of a court order for child custody. They told me that they would not bill be no longer. I updated my banking information on 4-29-13 and they said not to worry that until I came back in that it would no longer draft from my account. A few days later they again were drafting funds from my account. I contacted them immediately. I was not getting clear information from the employee I was speaking to, so I requested to speak to a manager. They informed me that they were not in. After making attempts to contact the "800" that no longer worked, I contacted them again and by this time I wanted to cancel the membership. They then informed me that I would have to make an appointment to speak to a manager in order to cancel my membership. No manager was available for at least a week. They informed me that they were booked with appointments. I tried to go in and cancel my membership and they refused me. Keep in mind that now I had to have surgery. After surgery I made an appointment on 5-29-13. I came in with crutches to sign to cancel membership. I had to change bank accounts because of other reasons and because the last payment never went through, they voided my cancelation. Fit U has continually been billing both accounts for several months. I recently contacted Fit U the other day and they informed me that both accounts have been closed and sent to collections. They informed me that the only way I can contact the corporate office is by email. I have contacted collections and told them that I cancelled this membership back in May, 2013.

I am requesting that Fit U remove all monies owed on these accounts and notify the collection agency that zero amount is owed. I am requesting that these accounts be deleted from my credit report.Desired Settlement: requesting no money be owed

delete these accounts from my credit report

Review: I joined this gym in may of 2013. After the delayed opening I received an email stating the gym was now available for use. Shortly after that the relationship I was in ended and since we had joined the gym together, I decided to end my membership so that she could have her private space at the facility. I went to the location I joined in August to request a cancellation of my membership/the agreement I received from Fitness Evolution in an email. I also wanted to discuss my account because I had never been billed. When I talked to the associate at the front desk I was inform that I did not have a membership therefore there was nothing for me to cancel and that was likely why the card that I had given to be charged had never been billed. I left the facility and and joined a different gym a week or so later. In late October I got a letter in the mail from a collection service. When I called they said that my Fitness Evolution account was past due and I needed $128.96. I explained the situation to the service rep. They said that my account would be put in a hold status until I could resolve it. I contacted the manager [redacted] at the Brook road location and explained the situation. He said that I was a member and acknowledged that I had never used my membership once. He also said that my name was at the bottom of the list and that some of the employees could have missed it if they didn't know how to search using my phone number. He said that he had no power to make any considerations but that he would ask his regional manager [redacted]. After a week and no call was returned I contacted [redacted] again. He told me that his manager deducted the $10 late fee but that I would have to pay the remaining balance. I tried to contact [redacted] by phone and by email. He never returned my calls or replied. I have also attempted to contact the corporate customer service dept. through email and got no response. I feel that I am being unfairly treated and have just reasons for not paying.Desired Settlement: Clear the account for all charges, cancel my membership and make a restitution payment if my credit was damaged as a result of their in appropriate appropriation of a collection service.

Response:

I spoke with [redacted] from the company and he stated that the consumer did sign up for membership in May 2013. That billing went through fine but the next bill in July came back invalid account number. Since then all the billings have come back as invalid account number and that is why the consumers membership is in collections.

I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Review: On August 18th I received a phone call from collections on be half past dues from "Fitness Evolution". There is a contract stating I renewed my services on 3/26/15. When I never approved such transaction. Before they were Fitness Evolution they were "Max Fitness" and my 1 year contract expired in March of 2015. I never accepted any transaction from Fitness Evolution therefore I believe this is fraud. The sales transaction apparently took place 3/26/15 from a [redacted] without my approval, or knowledge. I talked to a lawyers about the situation and they recommended I came to Revdex.com to fill out a complaintDesired Settlement: get me out of collections and to cancel all ongoing transactions in my name.

Review: Fit u, previously known as Gold's gym withdrew around $469.96 dollars from my bank account without my authorization.

I contacted Fitness Evolution about some unauthorized fees (a total of around $469.96) this company has withdrawn from my personal bank account.

Issue No.1

On March 24, 2012 my husband, [redacted] and I signed a contract with Gold's Gym which included payments for the first and last month of use. We did pay a total of $82.81 ($35.14 for [redacted] and $47.67 for [redacted]'s first and last month of use).

When we decided to cancel the membership we were again charged for the last month of service, and I paid a total of $49.98 to cancel both memberships. I had totally forgotten that when we entered in the contract, we had paid for the last month's subscription. Also, while reviewing my bank account some days ago, I found, that another unauthorized payment was taken on 5-7-2013, again for $49.98.

I went to the gym on May 9, 2013 at Hammer Ln in Stockton, CA to put a claim to get my money back and also sent an e-mail to the corporation (they do not have a phone number to call) in regards to this matter, but there has not been any response.

Issue No.2

Also, back in June 2012 Gold's Gym (now Fit U) withdrew $370 dollars from my account without my authorization, because they said I had a contract for 6 months to get personal training. I NEVER signed a contract to get training. I had actually just agreed to pay for one month training trial for my cousin [redacted], it had to be only a onetime fee of $80.00 dollars. However, they kept charging me every month until I put a stop payment with my bank.

The gym's representatives insisted I had a contract with the trainers, so I requested a copy of the contract (that I had "supposedly " signed). No one at the gym ever gave a copy of that contract. They said it was lost and that I needed to contact the corporation directly. I did contact the corporation, but they stated that since the contract was under my cousin's name she had to call. Unfortunately, my cousin was just on vacations in the USA and had left to her country some time before this issue started. But they kept charging me!

After several weeks trying to collect payment from the gym, I got tired and just let time pass to see if they did something to give me my money back. The trainer that had helped us to get involved in the program told me that he was going to make sure I got my money back, that never happened.

I am tired of that business; and I feel very frustrated because there is no other way I can communicate with them other than by e-mail; and they are not responding. I want my money back and no one is doing nothing to get this issue solved. I have copies of the contract with the gym and the payments I made, as well as copies of the confirmation page they gave me when I cancelled the service. I can also provide with proof of the unauthorized transactions they have done.

How can I get this issue solved?

Thank you for your help.

Sincerely,

[redacted]Desired Settlement: I just want my money credited back to my bank account and I want someone from the gym to contact me immediately to let me know what they are doing to solve this issue. I need copies of every single paper I have signed where I supposedly "authorized" the unauthorized charges.
