I am rejecting this response because: I'm sorry I just really am having a hard time with this I don't feel that my file has been taken care of the way it should beI signed up for auto-payIt was not taken out of my account like it was supposed toAnd because of that my payment is late and now my credit has a ding in itI don't understand how that is my faultAlso like I said before I have had the same phone number for years they have had my phone number on file since day oneAs I said before this is my fourth or fifth car with GMACI think I am being treated unfairly and this really upsets me.I work in customer service and I know for a fact when somebody doesn't make a payment you reach out to them you find a way to get info to themYou email them you call them you send stuff in the mail I got none of thatThat's why I thought everything was taken care of I was out of town my grandma died a tragic death she fell and hit her head and we had to sit there and watch her die it was horrificWe had minimal service there and I came home to this mess I really can't emotionally deal with this right now but I can tell you I'm extremely extremely upsetI feel like you guys have all my contact info but you didn't care to use it to let me know my payment wasn't taken outSigning up for automatic deduction makes people not have to think or worry about their payment because in most cases things are taken out correctly.....but in my case someone dropped the ball and it never got set up correctlyAnd I was told if anything is wrong with my payment they would let me know that never happened....can I just pay it in full and close my account? And go elsewhere???? I was going to probably? lease another Chevy Equinox but now I'm thinking I'm going to switch over to Jeep

signed a Retail Installment Sale Contract for the purchase of a Chevrolet Cruze in the amount of $31,at an interest rate of 11.90%Within the agreement, you agreed to repay the loan in monthly installments in the amount of $per month, beginning on March 13, The contract is a simple interest contract which means interest accrues daily on the unpaid principal balanceIf all payments are paid by the due date, the account will be paid in full on the contract maturity date
On January 2, 2017, the vehicle was involved in an accident and declared a total loss by Progressive Insurance On March 8, 2017, GM Financial quoted a payoff in the amount of $15,good for days to Progressive Insurance and yourselfOn March 21, 2017, GM Financial received a payment from Progressive Insurance in the amount of $8,As per your contract, the payment was applied to the balance of your account reducing what you owe We may apply each payment to the earned and unpaid part of the Finance Charge, to the unpaid part of the Amount Financed and to any other amounts you owe under this contract in any order we chooseInsurance proceeds will only be applied to the principal balance of the account
Within your contract, you also agreed to pay us all you owe under the contract even if the vehicle is damaged, destroyed or missingThe insurance proceeds received from Progressive Insurance have been applied to the balance on your account and was not enough to pay the amount you oweThe amount required to pay off the account on the above vehicle is $6,This payoff must be received by April 6, and is subject to change if the payoff expires, changes to the account payment history occur or fees assess to the accountThe daily interest amount for this payoff is $ At this time, a gap insurance claim is still pending

On May 16, the decision was
made to place the vehicle out for repossession, as allowed by your contractAt this time the account was over days past dueThe “Notice of Right to Redeem or Reinstate” and the “Notice of Our Plan to Sell Property” were mailed to the address of record on July 10, These notices explained that you would be required to pay the difference between the amount owed to GM Financial and the amount the vehicle sold for, plus expenses if you opted not to redeem/reinstate the vehicleAfter the sale of the vehicle at auction, a “Deficiency Calculation” letter was mailed to the address of record on August 27, to inform you of the remaining balance owed
GM Financial is required to report truthful and accurate information to the credit bureau reporting agenciesOur research concludes that the account status and payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the account and credit agencies

I am rejecting this response because Ms*** response completely ignored the fact that I forwarded copies of the original email threads to GM Financial President & CEO *** ***, Exec VP & HRO *** ***, VP & Executive CFO *** *** reflecting the dates of my account and credit inquiries to *** *** ** June 29, (7:am), July 9, (12:am), August 11, (9:pm), July 22, (1:am) of which the July 22, indicated an incoming payment of $1,for August 10, ? *** never responded to even of these emails? I was told on August 7, when I called that he is now VP in another area at GM Financial and there was no note to the account and thereby I was told on August 7, (when the vehicle was seized prematurely), the account was put in repo status August 1, ? This is not the first time *** has not responded to emails from me? I have provided prior date and threads ? which *** has not addressed either? The vehicle has been delivered as of August 14, ? It is obvious from the response I received from *** August 8, that upon getting his new position he did not feel accountable to responding to my emails nor delegating anyone to respond to my inquiries? Therefore, I was left unanswered although has been my direct contact since my Attorney General complaint? How was I to know any different? ? To date, GM Financial is not providing satisfactory response to any of the other concerns I addressed in my complaint beginning with1) Email was sent to *** *** ** July 22, advising $1,would be sent to the account by August 10, ? I was notified on August 7, that Mr*** did not document the account? Therefore, the account went into repo statusMr*** has been my direct account contact since my Attorney General complaint ? There have been a few occasions where there were no responses to account nor credit inquiries on June 29, (7:am), July 9, (12:am), August 11, (9:pm), July 22, (1:am)Correction to my account and credit report and reimbursement for erroneous fees due to the account not being documented by *** *** **? Violation of FCRA provisions(a) failing to correct inaccurate and derogatory information to credit reporting agencies(b) failing to follow up on credit reporting disputes(c) failing to refrain from continuing to submit information that you know to be inaccurate, and(d) providing results of the investigation of the dispute within five (5) business days after the investigation is completed;2) Violation of FDCPA of phone contact attempts by *** *** after he was notified multiple email exchanges to communicate in writing as August 8, (12:pm); ? *** *** required phone contact as a requirement to secure the vehicle AFTER the reinstatement arrangement Monday, August 7, and payment August 10, which was emailed to him with copy of the insurance policy? A copy of the recorded conversations with Allison, *** *** and *** *** on August 7, 2017Problems such as this is the primary reason why I make my communications with GM Financial in writing so that I have time/date stamped record.It appears this may have to go into litigation for resolve
