a Retail Installment Sale Contract (“Contract”) for the 2012 Chevrolet Impala in the amount of $34,630.67 at an interest rate of 11.90%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $678.36 per month, beginning on June 5, 2012. The contract is a simple interest contract which means interest accrues daily on the unpaid principal balance. If all payments were paid by the installment due date, the account would be paid in full on the contract maturity date. In review of your account activity and payment history additional interest  has accrued over the life of the loan due to payments being made after the scheduled due date and deferments that were processed at your request. Over the life of this loan; four deferments were processed at your request for the months of August and September of 2013 and June and July of 2014. The account has also been paid past the installment due date on numerous occasions; including 3 times over 30 days past due, 1 time over 60 days past due; and 1 time over 90 days past due. It is important to understand that when payments are paid late or deferred, interest will continue to accrue on the unpaid principal balance.  Please understand that enrollment in the GAP program is voluntary and is not required to obtain credit. You purchased this GAP program from Western Diversified Services, Inc.; not GM Financial. As such, GM Financial cannot account for what the GAP program will and will not cover in the event of a claim. You will need to contact Western Diversified Services, Inc. to discuss your policy. GM Financial received a payment of $4,395.20 from Western Diversified Services, Inc. on August 17, 2015. The remaining amount required to pay off the account on the above vehicle is $4,721.55. This payoff must be received by September 5, 2015 and is subject to change if the payoff expires, changes to the account payment history occur or fees assess to the account. Included for your review are copies of your Contract, Account Payment History, and GAP Addendum. Should you have any further questions or require additional assistance, please contact the Total Loss department at 1(877)203-5536. Sincerely,GM Financial

I am rejecting this response because: GM Financial received funds from me which were lost for 4 weeks. I have yet to receive an explanation for how this happened. Personally, I feel that the credit should remain on my account and the money should be refunded to me. More importantly, I hope this response serves as a warning to other consumers. This situation cost me time, interrupted multiple work weeks, and elevated my anxiety to a terrifying degree. I felt helpless throughout the entire experience. Ultimately, a corporation took money from me and failed to provide the purchased service (lease account credit) for 4 weeks. There was nothing I could do and no way to hold them accountable. I did not feel like resolving the issue was a priority for GM Financial.

I am rejecting this response because:  It is not a true response in regards to my issue - the personnel at GM Financial are simply replying to let me know they are reviewing my complaint and that an answer will be sent as soon as the review is completed.  This is the same tactic they used when they did not respond to the insurance claim - they gave me the run around until the car was sold.  I wish to keep this complaint with the Revdex.com active/open until a true response is received that reflects a sincere, honest, fair review.

My complaint was very straightforward and did not require a canned response from GM Financial. I will not subject my mother to their "request" that she contact them regarding the issue of continuing to send invoices to my dead father after he has been dead for over a year. For the record, I called and spoke with a GM Financial Representative on more than one occasion. So if their policy is that they can't discuss the issue with anyone other than my mother then they need to let their representatives know that. The purpose of my complaint was simply to let them know that their actions (actually lack of action) is unkind and inhumane. I require no further contact from them and if we continue to receive mail from them I will simply return it every time unopened, return to sender. Any further contact will be ignored.

I reject!  The contract clearly has my correct address and GM Financial stated McMinnville OR was the only address they had.  I do not nor have I ever lived there or listed it as my address.  The contract clearly states McMinnville,TN.  I do not know if any letters were returned but I DO know they were not received by me.  I also did not call and get a payoff amount of over seven hundred dollars and then only send a little over one hundred to pay off the debt.  I also dispute the automated calls which have just been introduced.  I did not receive any calls regarding a balance due after my last payment was made.  I have paid the disputed amount because I had to get the title released but as of this date I have not received the title was it sent to McMinnville OR also or will I call six years from now and be told I must pay something else before it can be released? The contract you keep sending me clearly has my correct address, I paid my account online, and I NEVER received notification of any type there was any balance due until I made the second telephone call trying to get my title on a account I was told each time I check with you was Paid In Full?

Per your lease agreement a payment of $226.00 is due on the 18th of each month. We received a payment in the amount of $463.98 on April 19, 2016...

for the March and April of 2016 base rent payments. At this time the account was 32 days past due for the March 18, 2016 installment due date. Your MyAccount profile will not reflect a balance until it becomes due. Our records reflect that the account was reported more than 30 days past due in April 2016 for the March 2016 installment due date.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and account payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting of your account.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  GM Financial would like my account number.  I am sending this through you to forward to them.   My account number is [redacted].  The last four digits of my SSS # are [redacted].  Please let them know that I do not want any information that tells me that  I need to take another step to get my car title which is what I have been given for the past 2 months.  It was paid off through them and I never received it,  DMV in California never received it and it is not at the WV DMV.  They should have it and I would like for them to send it to me.

payments are applied to the principal if the account is paid ahead and posted to any past due amounts first if the account is behind. Our records reflect that all payments have been applied in accordance with the terms and conditions of the contract.
It is important to understand that this contract is a “simple interest” contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on the face of your contract. Explanation of interest accrual, application of payments, and how late or early payments change what you must pay is explained on page two of your contract under the section titled “Finance Charge and Payments”. By signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 4.90% in 72 installments of $292.89, and any other charges within this contract.
