I am rejecting this response because: According the Credit Bureau's a "Charged off" mean a debt was transferred or sold to a third party and is no longer being held by that creditor.  As you have already said, this loan is now being managed by Harvest. So, in lieu a Charged off debt no longer holds a balance and or payment. If in fact this loan still recides with GM, then it is not a Charged off debt. All of your coorespondences are contridicting each other. Please EXPLAIN how you are reporting accuratly and cannot change the reporting to the credit bureaus. How can a CHARGED OFF debt still hold a balance?

Thank you for the correspondence sent to the Revdex.com regarding your GM Financial account. I have reviewed your concerns and would like to offer the following information. On May 26, 2014, both you and Jennifer Hutchinson entered into a Retail Installment Sale Contract (“Contract”)...

for a 2008 GMC Acadia in the amount of $15,954.30 at an interest rate of 14.99%. Within the agreement, you agreed to repay the loan in 60 monthly installments in the amount of $379.31 per month, beginning on June 25, 2014. According to our records on July 2, 2015, you advised a GM Financial team member that you had recently traded the vehicle in to [redacted] Chevrolet in Mooresville. During this conversation, you were advised by the team member that the payoff would need to be received prior to the account becoming 30 days past due in order to avoid derogatory reporting of the account to the credit bureau reporting agencies. Our records also reflect that an e-mail reminder was sent to you on July 21, 2015 and a phone call was made and message left for Jennifer Hutchinson on July 22, 2015. GM Financial received no response from either party to this account prior to the credit bureau reporting date of July 27, 2015. GM Financial management attempted to contact the dealership and a voice mail was left for the Finance Department on July 28, 2015.  An additional e-mail was sent to you on August 5, 2015 regarding the status of your account. On August 5, 2015 at 10:27am (CST), you contacted GM Financial, at which time you again reiterated that you traded in the vehicle on July 1, 2015. You were advised by the GM Financial team member that no payoff had been received and that you were still responsible for the account until the loan had been paid in full. On August 5, 2015, at 10:42am (CST), Karen with [redacted] Chevrolet contacted GM Financial and received a payoff quote. At this time, she confirmed that she had mailed a check to GM Financial in July; however, the check was mailed to an address not belonging to GM Financial. Our records do not reflect that we had received any contact from this dealership prior to August 5, 2015. The payment you reference made in June was received on June 23, 2015 and paid your May 25, 2015 installment due date. Check number 82116 in the amount of $13,576.46 for the payoff of your account was overnighted by your dealership on August 5, 2015 and received by GM Financial on August 6, 2015; when the account was 42 days past due.  GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and account payment history of your account have been reported to the credit agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting of your account. GM Financial has had no contact with any party to this contract or with your dealership since August 5, 2015 and no agreement or promise has been made by GM Financial to remove information accurately reported to the credit bureau reporting agencies or to refund any interest assessed under this contract.? Included for your records are copies of your contract and account payment history. Please note upon the origination of the lease you resided in Nevada where sales tax is charged on the individual monthly lease payment. In the state of Ohio it is required that sales tax be paid upfront based on the total amount of lease payments for the entire lease term.
As outlined in your lease agreement (See Page 2, under Other Terms and Conditions, Section H) it states, you must pay personal property taxes, ad valorem, sales, use or similar taxes assessed on the Vehicle, whether such fees or taxes are part of his scheduled payment. We may change the scheduled payment if taxes change.
A review of your account reflects communication has occurred between you and a GM Financial representative regarding the vehicle.

The most recent statement reflects the amount that is currently due $[redacted] and the amount that was not fulfilled with the last payment made on the account in the amount of $[redacted]. Please note these types of transactions are initiated and authorized by the customer only and any changes to the payment schedule would need to be made by you online.

I am rejecting this response because:You have handled this entire situation car free. Then you insult my intelligence by stating that you are "waiving the $526.91". You are not waiving anything, you are correcting your mistake by removing the 526.91 that I never owed you in the first place and if your dealership would have don't their job and immediately went to GM financial and said, Ronnie [redacted] just returned his Terrain on April 19th, 2017. Then we would not have this problem and I would not be taking time out of my work day to fight this and correct my credit. With what you have put me through, your offer is unacceptable and offensive. Get my credit fixed. NOW!

entered into a Closed End Motor Vehicle Lease for the 2017 Chevrolet Silverado. Within the agreement, you agreed to a 36 month lease term with a monthly payment in the amount of $328.50 per month beginning May 3, 2017.
Our records indicate your enrollment in the GM Financial automatic payment plan began on July 3, 2017. Review of your account reflects that no payment was received in the month of June 2017 and your account has been running a month behind since that month. Please be advised that the last payment posted to the account on February 3, 2018 satisfied the January 3, 2018 installment that was due. You are currently still due for your February 2018 installment payment. Please be aware, numerous efforts have been made to contact you regarding the status of your account.

I am rejecting this response because: I received a call from the lender shortly (10 days maybe)  after signing the contract for the car asking me questions. I answered her questions and after I did so she welcomed me to the GM family and advised me I would be getting a welcome packet in the mail. My Credit Application was approved based on my income and credit at the time in December when first sent from the dealer.

Please note that on June 11, 2015, GM Financial received a
completed fraud packet from Mr. [redacted]...

claiming identity theft. After a
thorough investigation, we determined the account was opened fraudulently and
removed Mr. [redacted] from the account. Upon further review of your account, our position
regarding this matter remains the same and we respectfully decline your request
to add Mr. [redacted] back to the account.
 
In regards to the divorce decree, please know that it is
between you and Mr. [redacted] and does not supersede the Retail Installment
Contract (“Contract”). Upon the final investigation of the account, you are the
obligated party and now solely responsible for the terms and conditions of this
Contract. I have attached a copy of the Contract for your review.
 
Please understand GM Financial is required to report
truthful and accurate information to the credit reporting agencies. Our
research concludes that the account status and account payment history have
been reported to the credit agencies with accuracy. As a result, we are unable
to comply with your request to make changes to your GM Financial trade line.

The poor customer service is still inappropriate and the lack of respect given to customers will make sure you are not referred to others. How you handle the situation is what counts and this was handled poorly. I understand the contract but the contract should not have to indicate that your customers deserve respect even if you have to deny them something. Be professional at the very least. I will still be speaking with my military legal department because no veteran should be treated so poorly.

A refund has been requested...

and is being processed. A check in the amount of $320.55 will be sent via regular mail to the address of record in the next couple of days. Please allow 7 to 10 business days from the time the check is issued for it to be received.
As outlined in the Lease agreement, you will be responsible for any base rent and late charges due at the time the vehicle was turned in. In addition to any excess wear and tear and excess mileage charges. Total termination charges are calculated after the Lease Termination Inspection is done to the vehicle. A final bill will be mailed to you if there are any charges pending after the vehicle was turned in.
We apologize for any inconvenience you have experienced as a result of this situation. Please be assured that we value your business and hope that you choose to continue to be a loyal GM customer.
