Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to provide the following information. On February 12, 2015, you entered into a Motor Vehicle Retail Installment Sales Contract (“Contract”) with The [redacted], Inc....

(“Dealer”) for the purchase of the 2015 Chevrolet Malibu. Employees of GM Financial were not present at the dealership during the signing of the contract and GM Financial was not an original contracting party in any agreements between the two parties. The contract was subsequently assigned to GM Financial. You promised to pay the amount financed of $28,827.69 and a finance charge of $11,870.31 which resulted in a total of payments of $40,698.00, if all payments are made on the contracted date they are due. It is important to understand that this Contract is a “simple interest” contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on the face of your contract, as well as on page two under “Finance Charge and Payments”. By signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 11.90% in 72 installments of $565.25 due monthly beginning on March 29, 2015. Currently, your account is 22 days past due for the May 29, 2016 installment due date.  A review of the most recent billing statement for your account dated June 9, 2016, reflects the past due amount in the amount of $565.25 owed for the May 29, 2016 installment due date and the current amount due in the amount of $565.25 for the June 29, 2016 installment due date; totaling $1,130.50. GM Financial understands that customers may face financial hardships throughout the life of their loan. Please understand that deferments are not a contractual obligation and are not always available. At this time, you have not yet established enough payment history since your last deferred payments in order to be eligible for this type of payment assistance. Please also understand that if your account becomes eligible for a deferred payment in the future, all deferments are subject to management approval. We would like to apologize for the poor service that you feel you have received. I am rejecting this response because: It appears that I will have to speak to a lawyer about this to determine if this really will be the final resolution on this. Months ago, I brought to GM Financial attention about these parking tickets that did not belong to me (I know that all conversation are recorded). I concerns were dismissed/ignored and was put on me to try and figure this out. It was at that time that I was even told by the City of Chicago, that if GM Financial insist on associating me with these parking tickets, I should seek legal advise. I have received parking tickets/violation (legal documents) and a bill for demand of payment to the amount of $1,294.44. The bill list out 18 parking tickets/violations and received only 13 so there wasn't even full disclosure of all of the parking tickets. I submitted two online complaints, which both were ignored. And, the fact that action was only taken once I raised this to Revdex.com appears to be the exact opposite GM Financial takes their customer serious. Nope. I don't think so. I have every right to dispute any charges, just like its my right to dispute credit card charges but yet, I have gotten daily recorded telephone calls and NOT one human being contacted me about this outstanding bill. Because if someone would have spoken to me, I would told them that I was disputing this bill. The way GM Financial handled this was 100% unacceptable.

Thank you for forwarding the additional correspondence sent to the Revdex.com.   Our records indicate on February 10, 2016, you made arrangements to pay $100.00 per month, however GM Financial only received one payment with regard to this arrangement. Any agreements are now null and void as the payment arrangement was not kept.   Please note that your account is now with an outside agency and you will need to contact them with questions regarding any additional agreements made. Lease agreement, you are responsible for Excess Wear and Tear and Excess Mileage charges as described within the Lease. Total termination charges are calculated after the Lease Termination Inspection is done to the vehicle.
As a courtesy, GM Financial waived $750.00 of the Excess Wear and Tear for the remaining lease payment as part of the GM Financial Loyalty Program. The program rules explain that any billable amounts that exceed $500 in excess wear or $500 in excess mileage will be the responsibility of the customer. As of the date of this letter a deficiency balance is still owed on the Lease in the amount of $354.08.

payments in question were paid online via MyAccount using Western Union SpeedPay on February 3, 2017 for the December of 2016 base rent payment, and March 3, 2017 for the January base rent payment. At this time the account was over 30 days past due for the December of 2016, and the January of 2017 base rent payment. These type of payments were customer driven, initiated and authorized.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the account and credit agencies.
A payment history will be mailed to the address on file separately. If you have any further questions or are in need of additional assistance regarding this matter, please contact GM Financial at [redacted].

I re-aver, re-iterate and re-allege all prior inquiries, complaints and responses as though copied herein in extensio. AmeriCredit & GM Financial have done way more than pay late at Christmas and the first month of college tuition. GM bailed out AmeriCredit and USA bailed out GM. Mr. Daniel E.  [redacted] has seen it all, yet I can't get help to be in a better position to buy a new GM product - a Buick Enclave or GMC Acadia - at income tax refund time. Is [redacted] still GM's Marketing chief?Lastly, it took almost a dozen inquiries to get documentation. Under the FCRA, the allowable delays were not met. Each such violation is actionable, with a minimum statutory liquidated damage amount.I will  get in touch with Mr. [redacted] and Mr. M[redacted] for their review during the Holiday Season.

On April 13, 2014, you signed a Lease...

Agreement for a 2015 Chevrolet Malibu. Within the agreement, you agreed to a 48 month lease term with a monthly payment in the amount of $420.06 per month, due on the 13th day of each month.
Please note that the lease buyout amount quote reflects the remaining base rent payments due for the lease contract should you return the vehicle to a GM branded dealership. Per your contract, the full pay off balance is required to purchase the vehicle.
GM Financial is unable to accept the lease buyout amount for a full pay off as the responsibility for this contractual obligation remains.

I am rejecting this response because:

The response from the company does not address my complaint - the fact that the finance company did not acknowledge the false information/misinformation provided to me with each attempt I made to resolve my financial hardships and inability to pay in accordance with the contract signed. When I made the last payment in the amount of $605.00 on 8/29/16 the payment was accepted and I was led to believe the company would continue to work with me to keep my vehicle. The fact that I was unable to speak with the company every day that they called - harassed during work hours every day - was explained the several times when I was finally able to answer and speak with the GM rep. The fact that there was an outstanding insurance claim was passed to every GM rep beginning with the voice mail message I left on the morning of 9/30/16 through to the person I spoke with through November. GM willfully decided to not file the clai** My complaint is that GM Financial did not provide fair business practices and willfully deceived me and my ability to file the insurance clai** I likewise kept in communication with Geico agents to advise that someone from GM Financial would contact the** If GM had contacted Geico as I advised, this matter would be closed and GM Financial would have the funds owed to them and significantly more than $7,000 - the amount reportedly earned from the sale of the vehicle.
Please address why the insurance claim was not filed, the lack of professional behavior of each GM rep, and the willful deceit in handling this matter.

I am rejecting this response because: According the Credit Bureau's a "Charged off" mean a debt was transferred or sold to a third party and is no longer being held by that creditor.  As you have already said, this loan is now being managed by Harvest. So, in lieu a Charged off debt no longer holds a balance and or payment. If in fact this loan still recides with GM, then it is not a Charged off debt. All of your coorespondences are contridicting each other. Please EXPLAIN how you are reporting accuratly and cannot change the reporting to the credit bureaus. How can a CHARGED OFF debt still hold a balance?
