I am rejecting this response because:It in no way addresses my complaint. As PREVIOUSLY STATED my account is closed, therefore there is no account number. In addition, there are numerous ways to contact me in order to verify information rather than asking me to send a social security number over email. I have a phone and can be contacted to verify information. I am still waiting on money that is mine and have not been helped in NUMEROUS ATTEMPTS when reaching out to customer service. Nick Cook assured me he would get back to me and he did no such thing... I am still waiting!!!!!!

On March 19, 2016, you signed a Retail Installment Sale Contract...

(“Contract”) for the purchase of a 2016 Chevrolet Equinox in the amount of $31,785.00 at an interest rate of 7.90%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $557.54 per month, beginning on May 3, 2016.
On March 9, 2017, the vehicle was involved in an accident and declared a total loss by USAA Insurance. On March 15, 2017, GM Financial quoted a payoff in the amount of $28,804.80 good for 10 days to USAA Insurance. On this same day, a notice was sent to your address of record which explained to you that you were still responsible for keeping your GM Financial account current during the insurance process, and until the balance was paid in full the account would still be subject to monthly credit bureau reporting. Please be advised within the contract, you agreed to pay us all you owed under the contract even if the vehicle is damaged, destroyed or missing. GM Financial received a payment from State Farm for the amount of $18,399.00 on March 27, 2017; however, insurance proceeds did not satisfy the balance on your account and a deficiency remained.
On June 29, 2017, your account balance was charged-off due to non-payment; at this time, the account was more than 120 days past due. On July 3, 2017 a Notice of Acceleration was sent to your address of record advising of the total amount owed under your contract. A review of our records reflects that attempts were made in effort to contact you regarding the status of your account prior to the charge off of the deficiency balance. On June 1, 2017, you spoke to a GM Financial representative who informed you of the status of your account and that it was still subject to credit bureau reporting. Per that conversation you declined to set up payment arrangements to cover the remaining balance. The GAP proceeds in the amount of $9,528.65 were received on July 3, 2017.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and account payment history of your account have been reported to the credit bureau reporting agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting.

I am rejecting this response because:  why do I need to wait for a check to be mailed??  The last attempt was overnighted, I want my refund overnighted.  Also, that was not an apology, that was a condescending remark.  The poor service 'I feel' - are you kidding me???? I can lay out point by point every failure, lie, misrepresentation, etc, I was hung up on - unacceptable.And to prove the lack of communication within this 'organization' I received a phone call Finally yesterday from GM financial.  Once again they assured me the check was being sent, overnighted with a true apology letter.  Completely different response then what they sent through you.  However, I have yet to receive my refund - I wont be holding my breath.

Included are copies of the property tax bills for your account.

On March 28, 2015 you entered into a Retail Installment Sale Contract (“Contract”) with [redacted] Chevrolet for the 2011 Chevrolet Malibu. GM...

Financial employees were not present at [redacted] Chevrolet (“Dealer”) during the signing of the contract and GM Financial was not an original contracting party in any agreements between the two parties. The contract was subsequently assigned to GM Financial.
Please note that GM Financial places a high priority on adhering to all state and federal laws. As required by La. Rev. Stat. Ann. § 6:966, a notice was mailed to your last known address on January 5, 2016, this notice also explained that Louisiana law permits repossession of motor vehicles upon default without further notice or judicial process. On May 3, 2016 the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was over 60 days past due. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.
We empathize with the problems you may have experienced with the vehicle; however, the responsibility for this contractual obligation remains. All mechanical issues would have needed to be resolved between yourself, [redacted] Chevrolet, and/or the manufacturer of the vehicle, if necessary.
Please understand that storage charges accrue daily and are owed separately to the repossession agent. The State of Louisiana is a redemption only state; however, in an effort to assist you GM Financial allowed reinstatement of the vehicle for the payment of the past due and late fee balances, and recovery costs. Our records reflect that you completed the reinstatement of this vehicle on May 10, 2016.
If you would like to obtain an additional copy of the notice mailed to your last known address on January 5, 2016, a subpoena is required.

GM Financial is stating that vital recovery should answer questions however GM Financial is reporting the account status. The reporting of this account as derogatory is incorrect and vital recovery agreed to remove this account upon payment. This account was paid as per the settlement yet the remove of the account was not completed by GM Financial. I also plan to submit a complaint for Vital Recovery as they need to address their actions as well. GM is responsible for the account status and needs to update the account per the agreed terms with Vital Recover

reflect that you were enrolled automatic monthly ACH payments to draft on your due date of the 21st of every month. Please note, you were advised on November 18, 2017 and November 20, 2017 that we require a notice of 5 business days in order to cancel the automatic payments and that the payment scheduled for November 21, 2017 would still draft.
Please be aware, the payoff check received from Burt Watson Freeland Chevrolet contained an incorrect account number and did not contain any information pertaining to you or your account. GM Financial was contacted by the dealership on November 21, 2017 and additional information was provided to locate the funds in question. The payoff was posted to your account on November 30, 2017 with an effective date of November 7, 2017.
The overage refund is scheduled to be sent to you on December 30, 2017 per the standard time frame. You may contact our customer service department and provide proof of cleared funds for the November 21, 2017 payment in order to request an expedited refund.

If I agreed to 13.95 % interest that is already factored into my monthly payments of $361.11, how can you also charge me daily interest on top of that, Also your website says I have 9 payments, but when you request a payoff on the account, the amount owed is much more than the 9 payments!

$11,799.27 at an annual percentage rate of 17.99% due on the 1st of each month for a 72 month term. The contract is a simple interest contract which means interest accrues daily on the unpaid principal balance.Notification of the type of contract is fully disclosed on the top of the first page of the contract. A full explanation of Finance Charges and Payments is explained on the back of your contract in the first section titled “FINANCE CHARGE AND PAYMENTS”.   When you signed the contract, you agreed to the terms of the contract and acknowledged receipt of the completed contract and that before you signed this contract, it was given to you and were free to take it and review it.GM Financial received payment for the August 1, 2015 installment due date on September 17, 2015; when the account was 47 days past due. The account was reported 30 days past due to the credit bureau reporting agencies on September 1, 2015.Please understand that GM Financial is required to report truthful and accurate information to the credit reporting agencies. Thank you for your response. While I am not disputing having
a signed contract with your business regarding repayment of an auto loan for a
2014 Nissan Maxima, my contention is that such contract was terminated in
December 2015 when I contacted your business and requested that the 2014 Nissan
Maxima be repossessed and to this date, the 2014 Nissan Maxima is yet to be
assigned for repossession.
During this entire ordeal, I have kept in constant contact
with GM Financial and kept them abreast of what had been transpiring. I
contacted them in December 2015 shortly after [redacted] had been
incarcerated and informed GM Financial that the police and my insurance company
have not been any assistance in locating and securing my car even when neither
of the registered owners were in possession of the vehicle.
When I initially contacted GM Financial in December 2015
requesting that the vehicle be repossessed, I was informed by GM Financial
staff that although I am requested repossession, GM Financial was unable to do
so with the account being current and was instructed to miss a payment first in
order for repossession procedures to begin. I did as instructed, and missed the
December 2015 payment and called GM Financial after missing said payment and
asked when the 2014 Nissan Maxima would be scheduled for repossession and was
informed that, repossession procedures are not instituted with just one missed
payment. I then missed January 2016 payment and contacted GM Financial and
again asked when the 2014 Nissan Maxima would be slated for repossession and
the customer service representative was again unable to provide the criteria or
date when repossession procedures would begin.
My intent in missing the car payments is so that GM
Financial can assist in locating and retrieving my 2014 Nissan Maxima, as they
are my last resort in locating and returning my car. I have made it clear in my
multiple phone calls and certified letter to GM Financial that I am more than
willing to pay all past due payments, repossession fees and relocation fees,
etc once my car is located and returned to my possession and yet GM Financial
has failed to begin repossession procedures disregarding my request and offer.
As lien holder, GM Financial has a responsibility to know the location of their
investment and have an invested interest in its condition, by continuing to
allow the vehicle’s location to be unknown and not in the possession of its
owners jeopardizes the likelihood of locating it and it being in its original
condition. This has been the case for the past two months and as each day goes
by, GM Financial runs the risk of the vehicle being further damaged and un-locatable
which boarders negligence. It is further punitive that GM Financial continues
to report the late payments to the credit bureaus which adversely affects my
credit score and ability to purchase a home and additional vehicle yet does not
take action to repossess the car. The credit reporting by GM Financial is not
the full story, while the payments have been delayed, it is only so GM Financial
can begin locating the vehicle and once that is done, payments will resume and
fees associated in doing so will be paid.
As mentioned before, the original September 10, 2015
contract for the 2014 Nissan Maxima was terminated by myself in December 2015
when I requested (prior to any missed payments) that GM Financial located and
repossessed the 2014 Nissan Maxima. Again, in January 2016 I requested by phone
and certified letter that the vehicle be located and repossessed, each request
was met by GM Financial with no response or inaction to locate the vehicle. GM
Financial is just as responsible for the late payments as I am as they have
failed to act to locate and repossess the car yet report the late payments to
the credit bureaus without the explanation of my offer to pay such late
payments once vehicle is located. While when signing the contract on 9/10/15,
both owners were employed full time and married, since then, the parties have
separated and will be divorced in March 2016 and Mr. [redacted] is
incarcerated in LA County, CA jail, unemployed with no way to pay for the
vehicle. I am not responsible for what another owner chooses to do with the
vehicle and if I continued to pay on a car where I am unaware of its location,
it would only perpetuate the fact that I would not have any idea of where my
vehicle is or any hope of it returning to my possession. I am only requesting
assistance from GM Financial to locate and return the vehicle to me as I am the
only owner that is in a position to repay the auto loan and upkeep the vehicle.
