I greatly appreciate your review into this matter and yes the research did conclude they did adhere to the policy. However, my request for review was not to see if policy was followed, but to show how the word choice provided set an expectation that no issues should have prevented the deferment to become available. Since they are subject to management approval, I was asking if this can be done as a courtesy in the eyes of customer service. The contract nor the policy were ever in question. Your response was aimed towards the adherence to policy and not the wording of the conversation and how it could have led to false hopes. Thank you.

On December 17, 2012, [redacted] entered into a Retail Installment Sale Contract (“Contract”) for a...

2011 Hyundai Accent in the amount of $7,143.40 at an interest rate of 11.25%. Within this contract, both parties agreed to pay installments of $156.95 per month for 60 months beginning on January 31, 2013; and if the payment is not received in full within 10 days after it is due the parties agreed to pay a late charge of 5% of the part of the payment that is late with a maximum charge of $5.00.  As this is a simple interest contract, meaning that interest accrues daily on the unpaid principal balance; there is no grace period.
 
Courtesy payment reminder calls are made to all parties of the contract if the payment is not received in full within 5 days after it is due. Our records indicate that the last call made to any party of this account occurred on May 8, 2015 at 11:33AM. On this date the April 30, 2015 installment payment was 8 days past due. Our records reflect that a payment was submitted online via Western Union’s Speed Pay system on May 8, 2015 at 5:35PM.
 
Please be advised that a cease and desist has been documented on the account for your telephone numbers only. While you may no longer receive phone calls regarding the status of the account, GM Financial will continue to communicate with you to the extent allowed by law.
 
Included for your review is a copy of the Retail Installment Sale Contract. A copy of the Account Payment History will be sent to your address of record within 7-10 business days.

I am rejecting this response because: I received a call from the lender shortly (10 days maybe)  after signing the contract for the car asking me questions. I answered her questions and after I did so she welcomed me to the GM family and advised me I would be getting a welcome packet in the mail. My Credit Application was approved based on my income and credit at the time in December when first sent from the dealer.

I am rejecting this response because:You have handled this entire situation car free. Then you insult my intelligence by stating that you are "waiving the $526.91". You are not waiving anything, you are correcting your mistake by removing the 526.91 that I never owed you in the first place and if your dealership would have don't their job and immediately went to GM financial and said, Ronnie [redacted] just returned his Terrain on April 19th, 2017. Then we would not have this problem and I would not be taking time out of my work day to fight this and correct my credit. With what you have put me through, your offer is unacceptable and offensive. Get my credit fixed. NOW!

GM Financial was not present at AutoNation Honda Chandler during the signing of the contract and was not privileged to any agreements between the two parties. The contract was subsequently assigned to GM Financial.
We empathize with the problems you may have experienced; however, all mechanical issues would need to be resolved between yourself, AutoNation Honda Chandler and the manufacturer of the vehicle, if necessary. signed a Retail Installment Sale Contract for a 2012 Chevrolet Traverse in the amount of $34,606.57 at an interest rate of 11.90%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $678.11 per month, beginning October 20, 2012.
On November 21, 2017, the decision was made to place the vehicle out for repossession, as allowed by your contract. At this time the account was 60 days past due. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.
Unfortunately, we are unable to comply with your request to alter the terms of your Contract. Please understand that GM Financial does not offer refinancing at the time or similar programs; as a result, we are unable to offer you any opportunity to reduce the payment amount or interest rate. We empathize with the problems you may have experienced with the vehicle; however, all mechanical issues will need to be resolved between yourself, the dealership, and/or the manufacturer of the vehicle, if necessary.

GEICO General Insurance Company (“GEICO”). On August 16, 2017, GM Financial received a payment from GEICO in the amount of $21,793.20. On September 11, 2017, The GAP proceeds from American Auto Guardian, Inc. (“AAGI”) were applied to your account in the amount of $7,443.79. Once the insurance and GAP proceeds were applied to the remaining contract liability, you still had a balance of $808.37. The pro-rated warranty refund in the amount of $344.62 was subsequently applied to your account, leaving the remaining balance of $463.75.
In an effort to resolve this matter, GM Financial has processed a waiver for the remaining balance. Your account now reflects paid in full.

Our records indicate your enrollment in the GM Financial automatic payment plan began on July 3, 2017. Review of your account reflects that no payment was received in the month of June 2017 and your account has been running a month behind since that month. Please be advised that the last payment posted to the account on February 3, 2018 satisfied the January 3, 2018 installment that was due. You are currently still due for your February 2018 installment payment. Please be aware, numerous efforts have been made to contact you regarding the status of your account.

and is being processed. A check in the amount of $320.55 will be sent via regular mail to the address of record in the next couple of days. Please allow 7 to 10 business days from the time the check is issued for it to be received.
As outlined in the Lease agreement, you will be responsible for any base rent and late charges due at the time the vehicle was turned in. In addition to any excess wear and tear and excess mileage charges. Total termination charges are calculated after the Lease Termination Inspection is done to the vehicle. A final bill will be mailed to you if there are any charges pending after the vehicle was turned in.

GM Financial has requested that the appropriate credit reporting agencies remove the first GM Financial inquiry from your credit report, as the second inquiry resulted in a Lease Assumption. In the event that the credit bureau reporting agencies are unable to delete the inquiry, we have asked that at a minimum that they convert the hard inquiry to a soft inquiry. Please be advised that it can take the credit reporting agencies four to six weeks to update your credit report.
