EVERY DAY we receive MULTIPLE phone calls from GM Financial. Yet since I have made this report for help since I am getting nowhere with them privately they have not made one phone call. First reposnse was to ask me to provide more information as if they didn't have it already. I question the legality of taking payments, and deducting late charges before paying payment so that the car payment is never listed as "paid" damaging both credit and telling us we owe payments. Tried to handle this on our own but no one is providing proof that these are legal actions. Having had 6 different car loan carriers already I can tell you this is not the norm but need someone to look into this. They are completely avoiding dealing with this. Going to have to go to a "higher up" soon. Again I reiterate that we have suddenly had no calls since this filing however we revived calls every day on landline, cell phone, and even on a specified "do not contact line".

I will be filing a complaint with the Consumer Financial Protection Bureau because this indeed is an example of what happens in subprime lending (which GM Financial was already in trouble with them in 2014). A direct quote "It appears that these investigations, which include potential criminal enforcement, are looking into whether these lenders are securitizing and packaging loans for sale to investors without ensuring the quality of loans or fully disclosing their risks."  I was not fully aware of everything.

Thank you for the response, I'm looking forward to reaching a resolution for this.  My account number was [redacted].

This is a done deal, I can't change it, but their comments do not change how I feel about this company again I also stated in my comments everything they said. I said I knew the interest rate going in, I also stated that they may have put all the compounded interest daily in the contract but the average person does not understand all the information especially with the very high interest rate they charged I would not and did not expect hidden costs. They also stated on each call this was explained which it was not as per my statement the main reason I filed this complaint was because no two people in my numerous calls at the end after paying this off gave me the same answer. If you read the notes in the last month of my calls you will see how nothing was handled by any two calls alike. I don't want to go back and forth with us both saying the same thing over and over again it doesn't change anything. You guys sent me an unsigned title letter which I had to go to the clerk of courts and be sent home, so I called and asked them to fax a signed copy to the clerk of courts and was told it would take 24 to 48 hours, so after 48 hours I called the clerk of courts they didn't have the letter so I called back and was told it took 48 hours from the day after I was told this. So the next day I called still no letter. Each time I called I explained this car was sold and the people were waiting for the title. The last time I called I asked to have it faxed to my house, guess what I received the 2nd letter that was mailed before I received any of the faxed letters. I am sorry but I do not believe when I could not get a single faxed signed letter that this cust. service dept. was telling me every time how the payments were being handled. Thank you [redacted]

November 24, 2015I contact GM Financial and spoke to [redacted] [redacted], on 11/24/15 at that time I was informed that the settlement could be no lower than $1000.00 he was to send me the agreement/documents/letter in the mail  (I gave him my exact address including making sure he understood my apartment was D (stating D like David) and via e mail at [redacted].He also stated that after payment it would take 30-40 days for this to be updated in the system and sent to the three credit reporting agents - I am asking that this be expedited.December 1, 2015I did not receive anything via United States Postal Service or e-mail.  I then call him again.  He stated the letter was sent to apartment B, I also told him I did not get an e mail; stated he was taking it to customer service so they could e mail it to me.I can be contacted via ###-###-####December 3, 2015I did not receive anything any e mails and I again contacted GM Financial this time opting to speak with someone else other than Anthony.  I spoke to [redacted] [redacted].  He look at the information and stated the other agent for whatever reason did not put in the email (or didn't follow through).  He told me he would have it printed out signed by his manager and send it to me within the next 20 minutes.  that was approximately 1/2 pm eastern it is now after 5 pm and I have not received any emails. I am now requesting that this matter be turned over to someone who will follow through on taking the necessary steps so payment can be made and the credit reporting agencies will be informed.

Complaint: [redacted]
I am rejecting this response because: We are not comfortable with disclosing personal information to GM Financial.  In the past GM Financial has sent us falsified records,  forged documents, and harassed us for an alleged debt owed without evidence of its existence. We do not feel safe giving that information to GM Financial.
Regards,
[redacted]

My reason for rejecting the business response, is because to this point there frankly hasn't been one yet to my complaint. While GM Financial has reiterated my lease terms and sent me a history of that, at no point was I complaining about them. My complaint was that the GM Financial payment system reflected no payment was due until it showed 2 payments due in April which I immediately paid. I went to the Revdex.com with this in the first place out of curiosity to see if other consumers were having the same issue. Didn't need to look far as on 6/13 there was the same complaint of not knowing payment was due until after the fact based on confusion with the website. My experience was the same, seeing $0 due until after 30 days late. I've called customer service, been told it was known it could be confusing, and that you'll see a balance due when it's time to pay - along with the fact that there is a buffer period built in for you to pay beyond your due date. This is exactly what I did, as in the complaint from the 13th. In that instance, a similar standard response was given. In follow-up, GM Financial did decide to reverse the late reporting after, I assume, accepting that the website played a role...not solely consumer error. In my instance, I have received essentially a "go away" message from the company rather than a response. This seems directly at odds with what the Revdex.com stands for. The resolution I initially asked for was some understanding from the company that there is enough evidence of error/poor customer service/etc on the companies part for the way their bill pay system works to reverse the reporting of my account being 30 days late to credit bureaus. As the complaint from 6/13 wrote - GM Financials failure to acknowledge fault or take any steps to correct the error are incredibly poor customer service and are in violation of the Fair Credit Act and I will act outside of the Revdex.com if required. Regards,[redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted]2, and have determined that this does not resolve my dispute.
To whom it may concern,   My complaint number is [redacted]2. I am responding to the information you have received from GM Financial. Let me  start off by saying that I have spoken to a couple of different supervisors. One of the supervisor informed me that my payment was received in the payment  department and cashed and they could not read the back of it and transfer it  to another department.  I feel that as a paying customer who has not been late with any of my payment , should not be penalized for something it the company’s fault. This is not fair to  paying customer who do right by the system. It’s not fair to me that the company wants me to pay for there mistake. I do not have extra money for there mistake. They are charging me late fees for something I had paid on time. This is unacceptable. I have all my receipts from the time I received the car. All payment made on time. For me to be told by the Revdex.com I need to get a copy of the front and back of the money order is unacceptable. I would like for the Revdex.com to ask the GM Financial leasing company where does the payment goes when it the payment are mailed it in to there company. The money order was mailed in with the statement that is received and mailed back in with the payment. The account number is on the statement. The account number was on the money order. Explained to me, what is so hard. I am not trying to be difficult,  but it’s the principal. I feel that GM Financial leasing is not cooperating in this matter.  They had no problem cashing my July payment along with all the other payment they received. They stated that they will investigate, but I feel that they did not dig deeper to resolve the problem. Whoever you get on the phone, is only reading what notes someone entered. This is not helping the customer. They should start from the beginning when  the payment was first  received from there ADP department. They have my payment and the statement. There was a male supervisor that hung up this evening. It does not matter if the customer is irate or not. You do not hang up on a customer. This is not how you do business. What if the shoe was on the other foot. Now, I want to know how and what is the Revdex.com is going to do and handle this problem.  Please get back to me.
