On September 16, 2013, you...

signed a Retail Installment Sale Contract for a 2009 Ford Escape in the amount of $18,554.05 at an interest rate of 12.99%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $374.34 per month, beginning October 31, 2013.
On September 29, 2016, the decision was made to place the vehicle out for repossession, as allowed by the contract. At this time the account was 59 days past due. GM Financial received a payment in the amount of $749.48 on October 11, 2016, this information was also confirmed by your bank.
Our records reflect that we last spoke with you on September 28, 2015. Please be advised numerous efforts were made to contact you with regard to the status. The last payment on record prior to the repossession was made on August 19, 2016 in the amount of $374.74; at which payment was applied towards your June 2016 installment due date and partial payment for the July 2016 installment payment. A repossession fee is charged every time a vehicle is picked up, along with any other associated fees. Please note that if the vehicle is not reinstated or redeemed, the vehicle will be sold at a private sale.
Included for your review are copies of your contract, and account payment history. Should you have further questions or require any additional assistance, please contact the Reinstatement Department at ###-###-####.

On January 20, 2017, the...

vehicle was involved in an accident and declared a total loss by Go Auto Insurance. On January 31, 2017, GM Financial quoted a payoff in the amount of $16,175.13 good for 10 days to the insurance company. On February 14, 2017, GM Financial received a payment from Go Auto in the amount of $11,777.00.
As per your contract, the payment was applied to the balance of your account reducing what you owe. Insurance proceeds will only be applied to the principal balance of the account. You are still responsible for maintaining the monthly installment payments and are still subject to monthly credit bureau reporting until the account is paid in full. Please be advised you were informed of the credit marks if payments were not made verbally and a Total Loss letter was mailed to you on February 1, 2017 informing you of that. The insurance proceeds received from Go Auto were applied to your account balance and were not enough to pay the amount you owe.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Our research concludes that the account status and account payment history of your account have been reported to the credit agencies with accuracy; and as a result, we are unable to make any changes or deletions to the credit bureau reporting of your account.

Please enter your reason(s) for rejecting the business response below.I never received a telephone call in regards to late charges.  What sense would it make to pay a loan in full and just leave late charges owing? Had I known there was a balance it would have been taken care of at that time as well! Also, the loan company had my address incorrectly as McMinnville, Oregon not McMinnville,TN for the majority of my contract time so that may explain why a letter was never received by me, if indeed a letter was sent!  I realize I that this complain is a major waste of my time and Revdex.com resources but it is really the only way an average Joe consumer can warn others of unethical business practices.  I have paid the late charges (under duress) but I will continue to dispute the validity of those charges.

On March 22, 2014, you entered into a Retail Installment Sale...

Contract (“Contract”) with Lehman Hyundai Subaru Inc. for the 2008 Saturn Vue. GM Financial was not present at Lehman Hyundai Subaru Inc. (“Dealer”) during the signing of the contract and was not privileged to any agreements between the two parties. The contract was subsequently assigned to GM Financial.
Please be advised, in order for a due date change to be processed on the account, the account must be current or brought current with the request of the due date change at the time it was requested. Please note all previous due date changes were not processed because the account was not current at the time of the request.
A review of your account payment history indicates that a payment was received on April 21, 2017, in the amount of $284.00 with Conformation No. [redacted]; however, this payment was returned to GM Financial as unable to locate on April 25, 2017.
GM Financial is required to report truthful and accurate information to the credit bureau reporting agencies. Thank you for the correspondence sent to the Revdex.com. I have reviewed your concerns and would like to provide the following information.
Please note on January 17, 2011, you signed a Retail Installment Sale Contract for a 2009 Mazda 5 in the amount of $15,154.83 at an interest rate of 18.85%. Within the agreement, you agreed to repay the loan in 72 monthly installments in the amount of $355.70 per month, beginning March 3, 2011. At your request, GM Financial processed a total of eight deferred payments that extended the maturity date of the contract to October 3, 2017.
Your GM Financial account matured on October 3, 2017; at which time the balance was due in full for the amount of $4,639.75. Our records reflect that a maturity letter was mailed to the address on file on October 3, 2017.
Please be advised numerous efforts were made to contact you with regard to the status of the account. Our records reflect that we last spoke with you on February 8, 2018; at which time no firm arrangements were made on the account. The last payment received on the account was on January 29, 2018.
On February 15, 2018 the decision was made to place the vehicle out for repossession, as allowed by your contract. The account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal laws.
The “Notice of Right to Redeem or Reinstate” and the “Notice of Our Plan to Sell Property” were mailed to the address of record on February 21, 2018 by United Stated Postal Service (“USPS”) Certified Mail. Please note that after a review of this account, all statutory notices were mailed to you at your last known address. In accordance with the applicable law, the statutory notice provided information about how and when to secure any personal property left in the vehicle. These notices also explained that you would be required to pay the difference between the amount you owed to GM Financial and the amount the vehicle sold for, plus expenses if you opted not to redeem/reinstate the vehicle.

I am not being currently represented by an attorney but those  are the actions I am willing to take to get this matter resolved. I just wished GMFinancial as a company would of done their due diligence to investigate and research all matters regarding this issue. I am shocked and appalled that such a company is letting their employee get away with this type of laziness.
