The company says that they have tried to call me, I do not have a phone so this is not possible. They do have my email and I receive emails from this company frequently; although not pertaining to this dispute. In order to contact me an email should be sent.

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I received a call from 24 hours Fitness corporate office on 6/12/2015, and the representative named [redacted]. I addressed my concern about the increase of my husband annual fee increased from $29.00 to $79.00 all of sudden this year and she said there is nothing she can do on her side to adjust the annual back to $29.00. The reason she stated that the fee has increased because they have received many complaints from other members said the facilities and the machines are old in the fitness centers right now and they have to renew it in the coming years. And that's the reason they have to increase our fees. I questioned her that 24 hours fitness is a national big company and there should be a company forecasting or expenses plan all the time. When and how to maintain the facilities should be included into the company plan since day one, and it just doesn't make any sense that they have to increase our fees due to their enhancement of the facilities. Unless that was the plan since day one when we joined 24 hours fitness, they have planned our fees will be increased in few years after we signed the contracts. But then, they were not honest to us about the annual fees because we are not expected the increase when we joined the membership few years back. [redacted] stated that she wished there is something she can do to help us, but she is not allow to change to annual fee and the only thing she can do is give my husband an extra month to think about the membership with 24 hour fitness and will also reflect my thoughts to the uppers. My husband's fitness plan extended for a month will be due on July 26th, however, I'm still not satisfy about the situation. I [redacted]t them to keep their promise to have the annual fee back to $29.00 for all of us. This is the first time I encounter that I have to face an increase of 172% all of sudden for a membership fee.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.24hour fitness contacted me in response to my Revdex.com complaint.[redacted] from customer care explained that 24hour fitness wants to provide the best experience to its members and that costs more money than they were collecting. She specifically pointed out the money would be spent on cleaning clubs, adding and maintaining equipment and opening new clubs. They sent an electronic copy of my contract which contained lots of barely legible fine print.   Page 2, which contained section 3c regarding right to increase dues, appeared different than the other pages which she said was because it was probably a different color paper rather than because it was not from the original contract.  I would be happy to post page 2 as it does not have personal identifying info.    Section 3c specifies that 24h can only raise dues once per year and can only raise dues a maximum of 5% of monthly dues.    It states in the same paragraph that 24h can increase dues on prepaid plans annually.  The agreement did not specify the amount of the increase for prepaid plans although its inclusion in the same paragraph with the 5% limit on dues increases certainly suggests to the reader (if not contractually limits) the increase should be a maximum of 5%.   This was [redacted]'s rationale for why 24h can and did raise my premium 250% in one year.  Further 24h can do the same each year.  I not sure if the contract legally permits this, but it does not strike me as a better business practice. When 24 hour promotes and sells the prepaid plans, the selling point is that they lock you into an annual rate.  If that annual rate can increase every year by an unlimited amount then the member is not getting any rate lock or benefit at all and it amounts to false advertisement.  I get that there are costs of doing business and that they go up, hence the 5% dues increase clause.  I purchased a contact to get a low annual renewal rate.    If that low rate increases by 5% each year then that is a reasonable expectation and it is still a good deal to the customer.  Cleaning, maintaining and updating equipment are basic to running a gym, not a reason to raise dues 200-300% at one time.  Opening new clubs should bring in new members and more revenue and be financed accordingly, not be a reason to  raise existing dues astronomically.   Most businesses  whether it be electricity, health insurance, rent, even retail stores would keep any rate or price increase (if there is an increase) to a reasonable amount, <= 5-10% annually.  24h fitness has not increased my dues since 2010 so if they want to increase it by 5 years x 5% =25% that would be more understandable than a 250% increase.   To resolve this matter to my satisfaction I would like to see any rate increase be limited to the 5% referenced in section 3c whether I pay monthly or annually.  An agreement that says they can raise rates to exisiting members by as much as they want is no agreement at all.  I enjoy going to 24 hour fitness. I think they are a good fitness club and a good value compared to more boutique clubs. I would like to speak highly of them and promote them again.  But its reliance on clause 3c to defend a practice which may or may not be be legal but is certainly not a better business practice is not acceptable to the consumer.  I hope 24h fitness will demonstrate that it values its customers, both existing and new, and honor its contracts and keep any membership rate increases reasonable.
