I have received the consumer’s additional comments. As you requested, we have again reviewed this matter to see if we overlooked anything that might support a more favorable conclusion. Unfortunately, there is nothing we can add to what has already been stated in our previous correspondence. We have reviewed the reservation and verified that it is stated on the consumer’s contract page that the pick-up and drop off location will be for [redacted]. The contract page was initialed, which indicates that the consumer agreed with the terms and conditions of the purchase, including the [redacted] pick-up and drop off location. Please note that the consumer selects the pick-up and drop off location; Priceline does not enter default locations. The consumer was offered an exception to the cancel policy and offered the option to cancel for a one day rental cancel fee and agreed to this option. The consumer selected Priceline’s Name Your Own Price service for the
purchase of a hotel room reservation in the area labeled [redacted], MI, and
states that she did not receive confirmation for a
property viewed in a previous search on Priceline’s Published Price...

service.
 
 The consumer states:
 
“I reserved a room using
Priceline's "Name Your Own Price" tool. The hotel chain at which
Priceline reserved a room for me was not listed as one of the potential hotels
on the screen before I placed a bid.”
 
Priceline
does not guarantee or imply that the selected Name Your Own Price property will
be a hotel viewed in a previous hotel search on priceline.com.
 
On
each consumers’ contract page (including the contract page in question), we
clearly and conspicuously place the following disclosure regarding this matter
labeled under Important Information.

The hotel that is selected may or may not be one
that you have seen during a hotel search on priceline. Any sorting or filtering
options previously used will not apply to this Name Your Own Price request.
Priceline will immediately charge your credit card the total cost of your stay.
Rooms purchased through priceline cannot be cancelled, changed or transferred
and refunds are not allowed.
 
Consumers
who wish to stay in a particular property/location, have the option to select
from our Published Price service  where
consumers see a list of competitive prices across a wide range of hotels and
can choose his/her exact price, location 
and hotel.
Additionally, when the consumer submitted
the request and made an agreement with Priceline to purchase the reservation,
Priceline committed payment to the travel supplier based on that agreement. Our
record indicates that the consumer chose to dispute the transaction with the
credit card issuing bank. Once the consumer
initiates a credit card dispute with the intent not to pay for an authorized
purchase, and the bank withdraws the funds from Priceline outside the terms of
this agreement, and the reservation is cancelled.
This reservation remains subject to the policy
agreed upon booking, and we cannot issue any refund even if the reservation is not
used. Therefore, this is not fraud or deception as alleged, and the consumer is
responsible for payment in accordance with the terms and conditions of the
selected purchase.

hereto, is a copy of the consumer’s initialed contract page authorizing the non-refundable
terms and conditions of the selected purchase.

were unhappy with your hotel accommodations. We evaluate each participating
hotel on many different criteria, including cleanliness, guest satisfaction,
decor, etc. We are sorry to hear that your hotel fell short of this expectation
during your stay. We appreciate your feedback and contacted the appropriate representatives
at the hotel to share your concerns.

the room checked for any bed bugs and the results were negative. Mr. [redacted] also advised that he sent email to your email address at:  [redacted].
However, the email came back as an invalid address. Mr. [redacted] advised that he
replied to the review posted on TripAdvisor, and also provided his direct contact.
 
As a gesture of goodwill, the hotel offered to refund a one
night fee for your reservation in the amount of $195.31. This refund was
proceed by the hotel today, April 15, 2015.
Your bank will  post this refund to your account.

I am rejecting this response because: I did not go to the [redacted] website to book the car.  I went to the Priceline web site to set it up.  When I was at the car rental counter the [redacted] representative told me that my issue was with Priceline and not them.  She further explained that if I had booked directly with them they could have made some accommodations at their expense.  This is nothing but a situation where both parties are pointing fingers at each other.  Also if you go the Priceline website the car that was advertised is shown to seat 5 people with 4 pieces of luggage.  According to the [redacted] representative there was no way that particular car could seat that many people.  So this also was a classic case of false advertising.  In regards to me signing a contract with [redacted] at the rental counter.  What would you do if it's almost 10:30 p.m. in a crowded [redacted] Airport the day before a holiday weekend and you still have a 3 hour drive ahead of you.

I am rejecting this response because: If you read the original complaint that was made to [redacted], they approved my refund request - but stated that they were not in receipt of the tickets - nor had any control over the tickets - that was the responsibility of Priceline.  My family does not travel frequently, and only purchased these tickets for this tournamen - so a change of date would do us no good.  This is a bad business practice - and I will surely make sure all of my co-workers, friends, extended family, etc refuse to do business with Priceline.  I underatand now why people say to deal directly with the airline.  I could understand more if this request had not been with 14 days of purchase - or 69 days in advance.  My son had played AAU ball for years, and hopefully will continue to play for the next 3 years - I will do my best to ensure no one on these teams use Priceline ever again.

I have received the
consumer’s additional comments.  As you requested, we have again reviewed
this matter. We reviewed the notes and the
record associated with this case and confirmed that our agent did not advise
that we will waive the $200 cancel fee. Our records confirm that you agreed to
cancel the reservation minus the $200 cancel fee and the non-refundable $7.45
processing fee per ticket. The consumer’s selected reservation is restricted.
It cannot be changed, cancelled or refunded. However, due to this extenuating
circumstance, an exception was made to cancel the reservation with a fee. We are sorry that the cancel fee is non-refundable and
we are unable to assist any further in this situation.

I am rejecting this response because:First, I received this exact response from Priceline a day before they submitted it to Revdex.com and I already responded to them that their response was inappropriate. It is disengenous for Priceline to then submit the response to Revdex.com after I alerted them to their response being deficient.Here is the response I sent to Priceline:This response once again misses the issue entirely. I don't understand how no one that works for Priceline will admit that there is a problem with the search engine function. This was not an occasional lag. This appeared to be an intentional effort on Priceline's part to not correct a broken search engine. This instant price increase was occurring for weeks and each employee whom I contacted was not able to correct the issue. It is completely impossible and I would have to be the stupidest person ever to believe that every single time I searched that the price increased by $200 in one second when I would click to book the flight. In fact, other websites were able to accurately reflect the prices. Why wasn't Priceline? Priceline is trying to defraud their customers with this bait and switch tactic. In fact, I went directly to [redacted] Airlines website and their prices were lower that Priceline's prices. Your company clearly is just trying to rip off customers and as such I have no choice but to take my business elsewhere.
Priceline is intentionally inflating the prices after the search is completed. As I stated above, you would have to be a fool to believe that the prices change in one second. The price cannot always be $362 when I search regardless of the time and day and jump $200 when I try to book. That is impossible. If they were acting in good faith, they would admit that there is a problem with their search engine and fix it.I will never book travel through this despicable fraudulent company again.

I am rejecting this response because: It does not address the issue I raised. It dodged it. My complaint was that their advertisement is false/deceiving as stated in the home page of priceline.com: "Best price. GUARANTEED. We guarantee the lowest price in everything you book" (see attached image). The existence of exceptions to the "sale pitch" calls for either removing their "sale pitch" entirely, or placing an (*) after it with proper explanations at the bottom of the page.Priceline.com gave me a dull response such that this Revdex.com complaint appears as answered. But, their "answer" cannot be considered as an answer to the issue I raised. I will move my complaint to the state consumer protection agency under the [redacted]l [redacted]r and federal consumer protection agencies, with the hope that, with sufficient number of complaints, we could build enough momentum for a class lawsuit. There is a good number of customers that have similar experiences with priceline.com, so I am hopeful about this.
