The complainant ordered their engine and they did in fact order the wrong engine as the Engine ordered by the complainant is not the correct engine for a late model Ford FPickup TruckThe complainant never did activate the Free WarrantyIf the Complainant would like to get the correct

I also followed up with a phone call to confirm the cancellation on January 3, 2017, as this was the first business day the offices were open after my email on December 30. My order was cancelled based on an email that was dated December 30, 2016. That email states that the order was being processed. It does NOT indicate that the order had been pulled from stock or shipped. As a matter of fact, I have email which was generated AFTER my cancellation that clearly states that the order wasn't received by the Warehouse Procurement team until January 4, 2017, which is at least hours after the order was cancelled. I also have several email that indicate the order was still being processed as late as January 18, 2017. In those email, SWEngines reports that the engine is being cleaned even though the original item description states that the engine is already cleaned and ready for shipment. The email continue to inform me of delays in my order and ultimately the last email says that the engine has still not shipped as of January 18, 2017. Finally, when I last spoke with SWEngines, I was informed that the $charge was for time to pull the engine from a car. The original listing for this engine shows a clean engine, removed from a vehicle and apparently already in a warehouse. I do believe that there not was any work or time put into pulling this engine or preparing it for shipment based on the email sent to me from SWEngines, and therefore there is no claim to withhold a full refund for handling, restocking or shipping fees

The complainant was advised we pressure clean all of our engines On occasion water does get inside the piston chamber and this does not ruin the motor as long as it is drained and flushed as should be done with all used engines upon receipt and before installation This does not
constitute a defective product regardless of what the mechanics opinionWe have been in this business over years and have had this practice for quite some time Therefore, the engine sent was not defective and a 25% restocking fee plus shipping is charged if the customer wants to return per the Terms and Condition of the sale agreed upon when making the purchase

We would never claim to send out a refund check without reviewing the claim thoroughly so we are unsure where the confusion was here Regardless, as stated by our Representative, this transmission requires ATF fluid and using any other fluid besides this voids the warranty Regardless of
what the mechanics practices are this is still a requirement of the Free Warranty as it is a requirement of the manufacturer and would void all warranties if this was a claim with the manufacturer as well When we reviewed the claim we made this assessment based off the information given and the claim was denied We encourage the complainant to take this issue up with the installer who did not follow manufacturer specifications and also are concerned with the other customers who may be subject to the same issue in the future

The complainant is claiming we are denying the warranty claim even though he has submitted the warranty registration and this is not the case. The Terms and Conditions of the Free Warranty clearly states in the LIMITED LIABILITY FOR TRANSMISSIONS section: “Warranty must be activated within
business days of delivery OR ALL WARRANTIES WILL VOIDEDFalsifying information will automatically void your warranty.”The Terms and Conditions must be agreed to upon before making the purchase and is indicated by the standard checkbox seen on most sitesOur system records all attempts to activate the warranty automatically as a log fileThe email the complainant has attached does not meet the requirements to activate the Free Warranty, nor does it meet the time requirements as you can see on the attachment provided by the complainant. The Free Warranty was not officially submitted by the complainant until 7-5-as shown on the screenshot providedThe complainant has hand-written in pen the warranty was activated on 3-19-and our automated log files indicate no so such attempt was made until 7-5-which is reflected by the date on the screenshot named SWTransProof.pdf The system does not allow customers to go back and look at the process or online documents once the claim has been submitted. Therefore, the complainants claim was denied based on this informationAdditionally, the claim is denied on the basis of another violation of the Terms and Conditions of the Free Warranty: “Falsifying information will automatically void your warranty.” Please keep in mind this is a Free Warranty on a Used part and not new or rebuilt. Our Terms and Conditions follow the standards within the used part industry and is in no way designed to “scam” customers

We usually recommend that the customer replace with the parts from the old engine Our CSR explained this during their conversation BMW has plastic valve covers and we remove if any damage is present The Oil Pan was most likely replaced due to the fact they have different drive
mechanisms such as wheel drive versus wheel drive Additionally, none of the parts the complainant is seeking restitution for is covered under the Terms and Conditions agreed to when ordering: Engine warranties are limited to manufacturing defects in the block, heads, pistons, crankshafts, camshafts, rockers, and oil pumpsWe do not warranty any attached accessory parts, such as switches, sensors, cables, electronics, belts, hoses, water pumps, manifolds, wire harnesses, valve covers, brackets, flywheel etc. Therefore, we cannot assist in this matter any further

We sent Mr*** the wrong transmission on accident, we agreed to get it exchanged for him so we sent him a replacementWe had emailed him return labels accordingly and we have proof of thatHe now has the corrrect transmission, and says he does not want it anymore be cause he picked one up
somewhere elseWe now have to pick up both transmissions and re-stock them because he does not want them anymore

For your reference, details of the offer I reviewed appear below.The response of SWEngines is that warranty is void because (A) the engine was not installed within business days and (B) that proof of the mileage was submitted on Jan 2nd, which to SWEngines was also beyond business days. In regards to (A), the engine was installed within business days (I can provide a copy of the dated payment receipt made to the mechanic, if needed). In regards to (B), I provided proof of mileage on Jan 2nd. I still contend that this is within business days of the engine's arrival: business day was Monday Dec 19th, business day was Friday Dec 23rd, Monday Dec should be considered a holiday, business day was Tuesday Dec 27, business day was Friday Dec 30, therefore Monday Jan was business day 10. In actuality, Janshould be considered a holiday and thus Tuesday Jan 3rd would be business day 10. SW Engines entire argument rests on their assertion that both Dec and Jan are business days. They are making this assertion simply to void a warranty. As such, I request proof that SW Engines maintained business hours and operations on both Dec and Jan for all their offices and employees. Beyond retail stores, businesses offer both these days as holidays to their employees.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]The claim that they did not know where the engine went is not validI sent copies of bills of lading to *** on 9/5/14, again to *** on 9/17/and 1/11/followed by copies to *** on 12/11/and he confirmed receiving the copies on 12/16/when I was told for the 6th time he had to research it and promised he would call me backThey have received these copies times plus the ones I again sent you, yet no one has ever attempted to call back or make this rightThis has been going on continuously for months, and every time I do get a response it has been the same...send us proof so we can find where the engine wentIt took me less than minutes and a single phone call to Appleton Recycling to find out that the engine had been melted down for scrapIt was directed there from WebPro engines when I told them it was the wrong engine and that it needed returned for a refundI had no knowledge of Appleton Recycling until 6/3/when it was delivered, and the pickup order was issued by WebPro on 6/11-In short, they have used me to pay for their mistake and refuse to admit itI was offered a refund in June minus restocking fee (the engine was melted for scrap...not restocked) and shipping (They told me by phone a e-mail there would be no charges if it were the wrong engine before I purchased it)
